I bought a car 6 months ago , I had it less than 2 hours before I noticed a noise coming from it. It went back in the garage 3 days after collecting it, since then it has benign the garage every month except 1 where the garage had no space. It again has a fault , the garage are yet to book it back in, I have asked for a refund, to be told I can only get one if the motor ombudsman takes the action on? Is this true? They have offered to swap my car to the price I paid, however there are no cars to my spec and year available, so could be waiting a while? even looked at other models but all standard no higher end spec available. if they can't swap my car they said I can keep mine, which I have lost faith in, every month there is a fault , error or another engine noise.. 21 faults since owning the car... am I right, I can have a refund against the consumer right act 2015? The garage were due to call me yesterday no call and no reply to my email, manager no3 and still no real action being put into place?

Please provide the following info
The date when you took delivery.
The dates when the car went into the garage, how long it was in the garage, the fault and whether the garage fixed the fault.
You may be within 6 months after allowing for waiting time, or you may have been sold a car of unsatisfactory quality, unfit for purpose.
Do you use the car just for private use?

Without the info requested in my post above, I can't say which section of CRA applies, if it applies at all
Please be aware that if the dealer accepts rejection he is entitled under CRA to make a deduction from the refund for the benefit the vehicle owner has had. This deduction is normally based on mileage driven during ownership.
