Hi,
I had windows installed in December last year, by one of the big companies. They made a mess of the installation, they damaged my property and have not rectified the damage.
I believe I have given them long enough to resolve and would like to know if I can take them to court to;
A) Get the money back which I have already paid.
B) Cancel the plan to pay any more.
C) Receive the cost to make good their damage (and consequential damage) - after getting quotes from builders and painters etc.
D) Receive a reasonable level of compensation for the time I have spent trying to resolve the issues.
There is significant structural damage to a wall which needs fixing. The company acknowledged it needed doing and have not resolved (in a reasonable period of time).
It's almost twelve months since the original installation and I can't face dealing with them anymore.
One of the windows has not been fit correctly, it is unsealed underneath. Therefore, I don't think I have received the product or service I agreed to pay for and maybe this is grounds to terminate the agreement and be reimbursed for what I've already paid, what I'm going to pay, and for the consequential damage that I have no choice but to resolve myself.
I have no idea how to
A) Start a court case,
B) Who to speak to and whether it's a viable option,
C) Would a solicitor's fees be recoverable in court?
Really hope you can help because I'm lost.
PS. I have attached the T's & C's from our agreement.
