  • Want to take a well known window installer to court - Can I? Should I?

    Hi,

    I had windows installed in December last year, by one of the big companies. They made a mess of the installation, they damaged my property and have not rectified the damage.

    I believe I have given them long enough to resolve and would like to know if I can take them to court to;

    A) Get the money back which I have already paid.
    B) Cancel the plan to pay any more.
    C) Receive the cost to make good their damage (and consequential damage) - after getting quotes from builders and painters etc.
    D) Receive a reasonable level of compensation for the time I have spent trying to resolve the issues.

    There is significant structural damage to a wall which needs fixing. The company acknowledged it needed doing and have not resolved (in a reasonable period of time).

    It's almost twelve months since the original installation and I can't face dealing with them anymore.

    One of the windows has not been fit correctly, it is unsealed underneath. Therefore, I don't think I have received the product or service I agreed to pay for and maybe this is grounds to terminate the agreement and be reimbursed for what I've already paid, what I'm going to pay, and for the consequential damage that I have no choice but to resolve myself.

    I have no idea how to

    A) Start a court case,
    B) Who to speak to and whether it's a viable option,
    C) Would a solicitor's fees be recoverable in court?

    Really hope you can help because I'm lost.

    PS. I have attached the T's & C's from our agreement.

    Many good solicitors give a 30 minute free initial consultation then you could decide.
    If it's one of the big boys they will probably have powerful legal backup.
    I think from what you have said you have had shocking service and deserve compensation. However.........

      Thanks for telling me about the consultation process, I’ve never done anything similar so totally unaware of procedure.

        have you quantified your losses yet/
        If more than £10,000 certainly consult a solicitor, but do work out before you go what you want to know.
        If you only have a limited time consultation you don't want to waste it

          Is the company a member of any trade body you could contact? Also one off the wall idea - have you tried tweeting them and asking when they will resolve the damage done to your home? Sometimes gets results where official communication fails!
