CCA claim help

    And thats me done and dusted with them now. I told them i'm not waiting another four weeks for them to investigate. They've told me as its with the Ombudsman they will not comment further, i should contact my FOS adjudicator. Seeing as neither Ombudsman outcome (S77A or S77(1) complaints) will affect me taking them to court for unfair relationship looks like i'll have to put my money where my mouth is and take them to Court. I'm not looking forward to it if i'm honest, its driving me crackers as it is.

    Can anyone explain to me in what outcome may you get 8% simple interest on a claim vs restitutionary (compound) interest ?

    *Edit to add: I've reported their conduct the the FCA. I knew they wouldn't deal with me directly as a consumer, so i phrased it that way. They've acknowledged the report and its logged against them.

      Bit of good news and update. I now have a FOS adjudicator looking at this statements non compliant with S77A complaint. Can't see that being a complicated matter, they either comply or they don't. I'm hoping for an update in about a week.

      My lender will not entertain me one iota in any conversation, their Risk Compliance Division even told me to leave everything to the FOS.

      And my failure to comply with S77(1) complaint should be about a week or so behind it. They still havn't asked me for a mortgage payment in maybe five months..................

        OK, bit of an update. I'm probably talking into an empty shell but hey ho !! Someone researching the internet may one day come across this post.......lets hope its helpful. Ombudsman has asked me a series of questions. I find them very uncomfortable. I'm not "woke" or gonna go on about my Human rights or anything like that, infact if they asked me any questions like that then i'd just answer them , i'm really not arsed who knows or thinks anything. Here is what they have asked me:

        Please can you tell me why you believe the consumer credit act is applicable to your mortgage?

        Please can you confirm when and how you became aware your mortgage statements were not CCA compliant


        Please can you tell me if there are any exceptional circumstances that may have prevented you from making a complaint sooner?
        They are questions from an Ombudsman who is set up to deal with the public and informally settle complaints !! Luckily i can answer them. Just imagine thats ya Nan or Grandad asking the ombudsman ? Theres lots more in the letter, maybe i'll reproduce it later at some stage, but you get a 100% vibe they aint helping you at all. I realise they have to ask questions, but the very first one you would think would be directed to the lender who is regulated for such activities? If they don't know them they shouldn't hold a licence.

        They'll probably try hold me off at the six year claim limit, but thats fine for me. I actually only need a desision from them. And my S77(1)complaint has gotta come anyday now......... still no request for a mortgage payment. You'd almost think they where working in tandem.
