    Im new to the site and thanks for letting me join.

    im after some general advice regarding cabot financial, recently over the last 2 months they have been trying to contact me by letter/text and phone calls.
    I have received 2 letters from them stating i allegedly owe £1440 to the citibank plc,i can guarantee i have never had any financial dealings with citibank plc what so ever.
    last week i mistakenly answered my phone to a unknown number and it was Cabot financial,which their agent/rep went on to explain basically what they said in the letters,to which i replied that i have never had any dealings with the citibank nor have i had any credit,loans ect for the past 30 years.
    his reply was that this alleged debt dated back to 1995,i then asked him did he have the original signed and dated CCA to hand, to which he replied no and put me on hold for 10 minutes and never came back.

    if the alleged debt is from 1995,can i assume it will fall under the limitation act and be statue barred ?
    as ive said above i have never had any dealings with the citibank in any shape or form.

    Cabot have since tried to contact me by text and voice mail on several occasions,which i have ignored

    They have probably got their wires crossed. Do not reply further if they contact you. Having stated that this is not your matter, you can ignore them and do not loose any sleep over it. When such matters are not yours, it is sufficient to say that they are mistaken and should check their paperwork which is wrong.

      do you think they will try and escalate this further if i just ignore all the text,voicemails and future letters

        It could be that you were a victim of identity theft and credit has been obtained by someone else in your name.

        I wouldn't ignore it, I would write to them asking for a copy of the CCA, Default Notice, Notice of Assignment Citibank would have had to send to transfer the alleged debt to them and statement of account or date of the last payment made to it.

        Whether the debt is Statute Barred will depend on whether the last payment to the account or the default date are older than six years (five in Scotland) because which ever is most recent is what is relevant.

        Assuming they come back with the information and it is stat barred, I would simply write to them telling them you have never had any credit with Citibank therefore may have been a victim of fraud, but as it's stat barred it doesn't really matter and you won't be paying them.

          Hi thanks for the reply

          ive done a check with trustonline .org .uk on my current property of over 30yrs and it came back as nothing found.
          I understand it may only go back 6yrs but it proves there is no CCJs on the alleged debt.

            They are not alleging that there is a CCJ they are saying if you do not pay up they will file a claim to try to obtain one.

            Have you written to them asking for the documents I advised in post #4?
