  • Time Limit for Council to Issue PCN?

Is there a time limit (from date of offence) for a council to issue a PCN ?

I did find one website which states that there is a 28 day time limit for a PCN based on CCTV to be issued. (See below for reference).

However I have not been able to find verification of this anywhere else...

    Any advice?

    Reference from: https://www.appealnow.com/parking-tickets/time-limits/ :

PCN issued by CCTV under the Traffic Management Act 2008. This PCN must be served by the council no later than 28 days commencing with the date that the alleged contravention took place. If they do not the PCN is invalid and should be appealed - the council may not cancel it and the motorist may need to take the case all the way to the parking adjudicator. For the purpose of appealing this PCN is treated as a Notice to Owner (see above)

Assuming this is a parking contravention, the time limit is contained in The Civil Enforcement of Parking Regulations (England) General Regulations 2007.
    UK Statutory Instruments2007 No. 3483 PART 2 Regulation 10 (4) states:

Subject to paragraph (6), a regulation 10 penalty charge notice may not be served later than the expiration of the period of 28 days beginning with the date on which, according to a record produced by an approved device, or information given by a civil enforcement officer, the contravention to which the penalty charge notice relates occurred (in these Regulations called “the 28-day period”).

As this is a council generated notice you will probably get better advice from Pepipoo forums: FightBack Forums (pepipoo.com)
