  • warrant of entry to disconnect- right of appearance.

I have been treated with a disconnection notice.

I think it is in relation to a considerable back dating debt that they wish to enforce. To complicate matters, I now have a nine month old baby and winter has now arrived.

It would seem that the application process to apply for a warrant will not be intimated to mean they can just go and get a warrant and then gain entry to my house. I Don't think that I can lodge a caveat with the relevant court in Scotland as it is not one of the grounds to which a caveat applies.

how on earth do i know when to go to court to oppose the grant and get some time to negotiate this complex matter with the power company?

They should give you details of where & when the application takes place and therefore should be able to appear to argue why it should not happen.

Where did you get this information from?

In England they are not allowed to disconnect if there is anyone vulnerable in the house and have to prove they have written to warn of entry before a warrent is signed. Get in touch with the company and tell them you have a baby so they should not disconnect but that you will negotiate repayment.
