  • Money order claim

    I’ve had a hmrc money claim from my ex about agreement we made in divorce order. I’ve stuck to agreement but she’s is demanding hundreds pm instead of £10 anyway.

    id like to get it struck off as it’s just spiteful and already been agreed in the family court but no idea how to fill in form,which form how to pay court fee, when or what evidence I need to submit etc.
    solicitor fees are Over £1200 to deal with it just can’t afford.
    Heard it’s £255 to get it struck off. Would like to use a solicitor but they say there’s no guarantee it will be struck off and no guarantee they can claim money back from her for costs.anyone had any experience with striking off and an example of a form would be ideal.

    I wouldn’t apply to strike out the claim, I would defend it and let her have the expense of the hearing fee, then losing in a court.

    if you were successful in striking out her statement of case you would likely get the costs of the application awarded, but that is not guaranteed. And to protect you for if you were to be unsuccessful you would need to submit a defence anyway.

    I can help you do either, but just thought I would give you the option of not having to pay £255.
