  • Wording of will in reference to stocik and shares

A relative recently passed away and has left me as listed "all stocks and shares listed on the London stock exchange". I know that the relative thought that meant all shares & funds they owned under the Natwest banner. Unfortunately probate (NatWest) have told me I'm due a small proportion and only the funds listed on LSE with (I presume) the rest of the money, which is 90% of it, going to charity. The executors and all relatives know this money was meant to be left to me but what can I do? Some of the funds are government bonds in America / Asia etc but all under the Natwest account. I would of thought the solicitor who completed her last will would of made this clear but evidently not?

    Not all is lost!
Under the Administration of Justice Act 1982 application can be made to rectify a will.
A Will can be rectified if the court is satisfied that there was* mistake* a failure to understand the instructions of the testator by the person who drafted the Will.
*The application must be made within six months of probate being granted.

If rectification is not possible a claim against the solicitor for professional negligence might be possible.
