    my son received this email response today.


    Good afternoon

    Having reviewed the content of your defence, we write to inform you that our client intends to proceed with the claim.

    In due course, the Court will direct both parties to each file a directions questionnaire. In preparation for that, please find attached a copy of the Claimant's, which we confirm has been filed with the Court.

    Without Prejudice to the above, in order to assist the Court in achieving its overriding objective, our client may be prepared to settle this case - in the event you wish to discuss settlement, please call us on 0203 434 0433 within 7 days and make immediate reference to this correspondence.

    If you have provided an email address within your Defence, we intend to use it for service of documents (usually in PDF format) hereon in pursuant to PD 6A (4.1)(2)(c). Please advise whether there are any limitations to this (for example, the format in which documents are to be sent and the maximum size of attachments that may be received). Unless you advise otherwise, we will assume not.

        Well I would be responding by reminding them that I was not the driver, and that will be proved by reference to the cctv captured pictures, and also that due to non compliance with PoFA 2012 (as admitted in writing by themselves in letter dated dd/mm (as referenced in post 19 )liability for the charge cannot be transferred from the driver to the keeper.
        Suggest they discontinue the claim, or they face the prospect of an adverse costs claim for unreasonable behaviour..

          we sent that email no reply. but received in the post today "Notice of Proposed Allocation to the small Claims Track"

          i will upload a pdf later. what advice do you offer now at this stage.

                  Hi Guys,

                  Any further advice on this?

                  Tried mediation but they would not except my original offer of £1 for full and final settlement. it went back and forth they wanted £100, I offered £30 hoping they would except this as I stressed my son was not the driver at the time and the CCTV proves this. IMG_9479.jpg

                    it is typical of DCBL to push through to the last minute.
                    your son will have to follow court directions, and eventually produce a witness statement.
                    A hearing date will be given, and he should be prepared to attend court.

                    It is quite possible that DCBL won't pay the hearing fee (so the case is discontinued) or just not turn up for the hearing.
                    Even if they do appear for the hearing & it goes ahead your son should win.

                    Your son should not be concerned about going to court.
                    He has a very good defence, and you could accompany him as a Lay Representative if he wants support.
                    County court small claim hearings are quite relaxed affairs, generally with both sides and the judge sitting at pushed together desks.
                    No wigs or shouts of "objection" ... just a question (from judge) and answer (from litigants) civilized session

                      Thanks for there feedback.

                      My son is very concerned as he has just been offered a new job and has been asked to complete a Fitness and Propriety questionnaire.
                      He is making should he try and settle?

                        Even if he should lose in court, as long as he pays the judgment award within 30 days there will be no adverse entry on his credit records.

                        I would not try and settle with these people as he has a very good defence.
                        However if he would find it less stressful to settle than to continue to dispute, then perhaps he should consider so doing.

                          DCB are now calling him everyday on his mobile. so he is going to call them back on his lunch break to see what they want.

                            generally one advises not to speak with them, but keep everything in writing.
                            I would not consider them trustworthy, and would tell them the only acceptable method of communication is in writing (email or hard format).

                            If they want to negotiate it can be done eventually through the court mediation service for free
