Confusion over hearing when I couldnt attend

  • Confusion over hearing when I couldnt attend

    I informed the court as soon as I knew I wouldn't be able to attend they said it was fine and to email.
    Sent the email as soon I put the phone down got a confirmation saying they had the email.
    Ten minutes before the case was due to happen I get an email saying they could either set it for another date or have the hearing via phone. I email within 2 minutes saying could we do the hearing over the phone because I just want to get it sorted.

    At the time the hearing is due I get no phone call or reply to the second email.

    I ring up and am then told the judge is on dinner and to call again in an hour.

    Phone back an hour later to be told I sent this reply to the wrong email ( I have checked the email there is no alternative email to send the reply to) and that the case went ahead without me.

    I then ask what I can do and she tells me to send a email to the email explaining that I emailed back but apparently to the wrong email with no alternative email.

    I'm worried now because the case was to have a CCJ set aside that I had no idea about because I moved from the address two years earlier where they sent the court papers to.

    Do I have leg to stand on here? because if they havent ruled in my favour it seems very unfair as I did everything I could to be able to give evidence without being able to attend.

    Wait until you get the order of the court and if not in your favour you would make n application for relief from sanctions and to have another hearing.
