Help....What next?

Hello all,

I am in need of some guidance on the next steps to take.
I am the defendant in a case, the Claimant is a company.*
Disclosure of witness statements has taken place and the hearing is in approximately 8 weeks.

The Claimant was 1 day late submitting documents to the court and myself - I have raised this to the court, however the hearing continues.

I also have a couple of issues with the Claimants documents: -

There are a number of witnesses who all claim they are the claimants to the claim - although the initial money claim form states the company as the claimants address and 1 Claimant not multiple, is this legal?

One of the witness statements states a lot of information without any evidence to back up what they are saying, just hearsay in order to discredit me.

If I want to make a strikeout request the court has told me to apply with the appropriate fee. I’m not sure what form to submit, what the fee is or even if my application would have weight?*

what are people’s thoughts?

My first thought is what are you intending to apply to strike out? The Witness Statements or the claim?

The, under what grounds are you applying?

Theform is N244 and fee is £255, but if you are unsuccessful you are likely to have the other parties costs of defending the application awarded against you.
