High Court Enforcement Officers chasing company debt at my home address

Hi

I'm new here and would be really grateful for any advise. I'm based in the UK.

I'm being chased at my home address by high court enforcement company for a company debt. The debt is in the company name and I'm a director. There is no personal gaurantee. I didn't think this was possible. Is there any way I can put a hold on this being as I don't have any funds to pay and really worried that bailiffs will try and get into my family home when I'm not there and my family is.

They are entitled to chase the debt anywhere 'they believe' the business might be trading, but you can write to them to let them know the business does not and never has traded from your home nor are any of it's assets located there, so should they attend the property they would be trespassing on your private property and causing alarm and/or distress to your family which is behaviour they ought to know is contrary too the Protection from Harassment Act 1997 s.1.

Any future attendance at your private residence may result in you issuing proceedings against them in the county court without further reference to them and the police being called in relation to the harassment.

This is quite usual as you would be surprised how many company assets turn up at directors home addresses - cars, laptops etc. It is sometimes compounded with the company registered address being listed as the home address of one or more directors. They may only seize goods relating to the company and if none then then they must leave, they could rightly infer that the family Rolls Royce on the drive is company asset but if you can provide proof otherwise - not the V5 - then they have no option but to leave it. Strangely it is actually easier to try and engage with them rather than act against but just make sure your doors are well and truly locked and don't invite them in.
