  • Cost of a legal letter

    Ok so my husband had an affair. The situation has turned a bit fatal attraction and she is posting pictures of them together on instagram and Facebook. Nothing compromising but just as if they are a couple, he tried to contact her directly to get her to stop but she is a nutter and keeps posting. Rather than just request the sites to remove them we want to use a more heavy handed approach and do it by legal letter. We’ve been quoted £500 plus vat, is this about right as it seems a lot for one letter. Advice please

    Neither your rights nor your husband's rights have been infringed by publication, unless you can prove that copyright vested in either of you.

    No site is going to remove publications, just because either of you find that embarrassing.

    Price seems a bit steep, but the letter will have no legal effect absent a claim in copyright.

      Save your money the individual will just ignore it and there is nothing legally you can do if they own copyright of the images.

        Thanks for your replies. When I googled the problem my understanding was that someone can’t put a picture of you on social media (or any public media) without your permission. Is this not the case then?

          Your understanding is not correct, at least in the 3 jurisdictions in the UK, and probably most other countries. If your belief was correct, there would be very few photographs on the internet or in printed publications.

            Sorry, but you can't really do anything with that. I am using instagram a lot, I am a blogger and I know some details about it. I have a lot of subscribers ( I am using https://igautolike.com ) and from my experience, you can't oblige anyone to delete a photo, if it's not breaching the rules of the social media. That's it.
