  • How to request the change of the court address?

    Hi Guys, I am living in London and I have mentioned/provided the London small claims court address with the court code to Northampton Country Court Business Centre but they have forwarded my case to some court in the Dorset. which is 150 miles away from where I live. Please need your help guys.

          When you provided the address of the London court, what reason did you give for that being the one it should be transferred to?

          Also, has the claimant served a copy of their N180 form upon you and what was their reason for wanting the Dorset court?

          For anyone else reading this who is a defendant and an individual (not a business) the reason on the N180 should be "Defendants Home Court pursuant to CPR 26.2A(3)."

            Hi @Jagurauk, In the copy of N180 I have received from the Claimant, they did not fill the Hearing venue (D1) field and I have written the court address, the court code and "Defendant is an individual: "Defendants Home Court pursuant to CPR 26.2A(3)" and sent the form N180 to court and a copy to the Claimant. That's why I need your help and I am confused about it. Why? they have allocated my case to Dorset Court for a future hearing. Thanks, @Jagurauk for helping me.

              It seems like they have made an admin error, your first port of call would be to try contacting the court in Dorset, you could email and ask them to review your N180's as it seems there has been an admin error in allocation and asking them to reallocate it to the correct court. They may just do it, but if they come back tell you that an application is needed you can go from there.

              Is the claimant close to that court?

                  If youre looking to get a case allocated back to london be careful you dont land up with the Central London CC as that place is an utter nightmare.

                    Thanks,*pt2537*.*My*case landed at the Mayors & City of London Court. Which I have requested for in the 1st place. Is it really very bad? I am worried now. Can anyone please help me. I have requested a copy of the contract and account statement for Lowel. I have the proof of postage and the copies of the letter and £1 postal order sent along with. Lowell failed to provide me with any for the request documents. Actually, this is my gound of the case. Does anyone know how to present this to the court prior to my hearing? I will really appreciate the help. *

                      He was talking about the Central London County Court, which is different to Mayors & City of London County Court, so no need to worry.

                      You should have filed it in your defence, it's been a while and I don't have time to read back that you did. Your next thing to file will be a Witness Statement when directed where you'll tell your side of the story from a first person perspective and support the points in your defence. Until then it's a waiting game.
