Me again...
This time I wanted to know if a retailer can cancel an order without telling you?
Four of us ordered online from tesco for the first time. All individual orders. Payments were taken and confirmation emails received by us all. Text messages received the following day to advice us the times our deliveries were scheduled for and to make sure someone was in.
We all waited in and then one received part of their order only and us other three received nothing. Reason given was because the items were out of stock.
Now being out of stock isn't the issue, it's that fact that none of us were informed that tesco had cancelled our orders.
We are all currently unsure as to whether they had taken full payments or refunded payments or not actually taken anything at the time of ordering?
My actual point to this is, until we contacted Tesco, we wouldn't have known that they had cancelled our orders. Also, one of the four got a text message from her bank the following morning after payment, to say that she was overdrawn, ( we all borrowed her card at the time ). Can she claim back the charges if Tesco had taken the payments and then refunded later on? I'm aware that the Consumer Contracts Regulations 2013 states that we have 14 days in which we can cancel our order, but I can't find anything on the retailer.
So my questions are...
Can they legally cancel an order?
Is it acceptable that none of us were not informed about the cancellations or limited stock before Tesco cancelled our orders?
Do they have to offer an alternative if they are the ones cancelling?
Can X claim back her bank charges?
