Must claimant receive the documentary evidence the defendant has sent with defence?

Hi

The court sent me a copy of the defendants defence today. In it he makes mention of documents he has sent to the court in support of his defence but the court has not sent them to me.
The court has asked me to send in a directions questionnaire but should I have to do this when I have not seen his evidence?

Documents aren't usually sent with a defence - if documents are mentioned in the defence you can ask the defendant to see them however in order to rely on the documents the defendant will have to include copies with their witness statements when the court issues directions.

Whats the case about ?
Is it small claims or fast track ? ( is the DQ the N180 or N181?)

Yes. I thought of something else after posting the thread and as the original post was long enough I thought I would post this separately as I think it can be construed as a stand alone generalised query.
