  • Planning Authority use Highways Dept to hinder planning permission on unadopted road

    Hi all.
    I am a newby.
    My bro in law has house and land in Wiltshire. I have drawn plans for a bungalow on his land (a higher garden area). Planning are using Highways Department to hinder the application by saying an unadopted road, which my bro in law owns and is responsible for its maintenance. They are concerned about the access to the garage from the 2.4m wide access road and possible problems with 2 other houses which have access over his unadopted road.
    Does the Highway Dept or Planning Dept have power to stop the application on access grounds on an unadopted road access?

    Unadopted road could still be a public highway and access rules would still be implemented.

    Problems will arise with access for emergency vehicles, where normal required width is 3.8m

      There are 3 dwellings that already use that same road as existing, so that would probably not apply?

        Well it could if those homes were built before the current standards were drawn up.

        The access standards are quite complicated, but can be viewed at Building Regulations B5 Section 11 (https://www.gov.uk/government/public...ved-document-b)

        Perhaps you can somehow come up with an alternative route or widen existing road or discuss with planning some other compromise?
