I am a newby.
My bro in law has house and land in Wiltshire. I have drawn plans for a bungalow on his land (a higher garden area). Planning are using Highways Department to hinder the application by saying an unadopted road, which my bro in law owns and is responsible for its maintenance. They are concerned about the access to the garage from the 2.4m wide access road and possible problems with 2 other houses which have access over his unadopted road.
Does the Highway Dept or Planning Dept have power to stop the application on access grounds on an unadopted road access?
