  • Statute Barred

    Hi
Following advice from this wonderful site I sent a Statute Barred letter to Capquest in March 2019. I have had no response apart from a house call (at the end of May) from Resolvecall who put a note through the door. Yesterday in the post I received a wad of paperwork from Arrow Global relating to the same debt which says "Remediation of Account" and goes on to say 'under the rules of the Consumer Credit Act 1974......we are required to provide you with statutory notices within the prescribed timescales to inform you about the status of your account. We have recently identified that unfortunately we haven't always complied with the above mentioned requirements and as a result are carrying out a remedition to provide you with information we should have provided historically". The statements provided go from 31 March 2014 to 28 February 2019 all have the same outstanding amount on them. I am not sure where to go from here and would be grateful to receive some further advice.

Nowhere really, they're just doing some admin to bring them into compliance with the cca and fca rules, because they've not been great at that in the past, so unless there's anything there which changes your position that the debt is statute barred ( say a default notice that expired within the last 6 years or a payment made under 6 years ago - presumably Arrow only purchased the debt in March 2014 though )

I'd file it away and see if Arrow follow up with any demands for payment.

Any support I provide is offered without liability, if you are unsure please seek professional legal guidance.

Thanks, I have now had a chance to go through the wad of paper. there is a letter "Remediation of Account", 5 Periodic statements dated from 1st March 2015 to 1st March 2019 and 12 Notice of Sum in Arrears dating from 1st August 2014 all with the same opening balance as at 31st March 2014. It says to get in contact with Capquest who are handling the account on their behalf. I sent the statute barred letter to Capquest back in March but to date have still not received any response. Should I just continue to ignore it ?

Yes, unless they write to you asking for payment ( in which case reply stating 'statute barred'), you can just file it away.
