Executor Sign Off

Hi, I've received a copy of a letter sent to my brother, basically asking him to say if he has the 2 rings or not and return them to solicitors. Also to sign to say he will not make any type of claim against the executor within 21 days. If he does not respond they will go to court to get an "Order" what is this order?
They have said any legal costs will be made against him not the estate, what is the likelihood of going to court and howong will it take?

Hi Mercury55,
Afraid I can't answer that one, not knowing what order they are seeking. You need to ask the solicitor, as well as checking how long they think it will take. Some of the time element will be up to your brother. If he refuses to sign then inevitably delays will happen.

Hi,
I had a phone call from my Aunt, the executor 12 months after not speaking to her at all. Very curious as to why she called after all the trouble I've had. She said the solicitors told her that my brother is sending the items of jewellery and signing to say he will not be suing her. She said it should all e completed within 6 weeks She also said I was welcome anytime to her house, very strange. Would you believe what she says and would you advise contacting her or go through solicitors, it was as if the last 12 months had never happened if I do visit her would you advise taking a witness

She May have been advised to abandon any thoughts of claims, as I said before the cost of taking things further far far outweighed any possible benefit.
i would take it at face value. There is no rush to go visit is there? Maybe see if matters are now finalised and distribution occurs before deciding whether you wish to build bridges or not?

Hi, it's now been 4 weeks since my Aunt(Executor) called to say my brother was handing in the 2 remaining rings and signing to say he will not be suing her and everythingsshould be settled within 6 weeks, have not heard anything at all! If he has not done what he said he was going to do, and they are now taking him to court would the Solicitors have to tell the other 2 Beneficiarys what is now going on?
If not why is it taking si long to send out final accounts and distribution?
Should I contact executor or solicitors to find out, just afraid it's bad news, again!!!!

My Aunt(Executor ) called last night to tell me my brother had still not handed the rings in or signed Accounts saying he will not sue her afterwards. The solicitors are sending him another letter giving him another 14 days, as if it goes to Court they must show he's been given enough opportunity to do what has been asked. As he is the one beneficiary now causing additional costs can the charge them to him and not the estate, because he is just being stubborn and stupid. She does not want to go to Court but wants it finished, but will not distribute without him signing. Can she take out any form of insurance as we all want this over.
How can one person hold everything up and cause more costs let alone the Mental issues it's creating.
Can us as beneficiaries claim money from him as he's just sending costs higher and higher?
How does this end?

I reealy need some advice on thus even more bizarre case. My brother returned my late moms 2 rings and signed an agreement with the executors solicitor 2 weeks ago so everything could be finalised and distribution could happen. Yesterday I received a message from the executor asking if I will go and see if the 2 rings he handed in were actually my moms!
How ridiculous is this, I am not her errand boy to go running around. What if I say yes will she believe me.
How is thus being allowed to happen, surely they should be taken in good faith.
What if I say no, what she going to do then.
This has been going on for months.
What next, raise my moms body from the grave, make sure it was her that died?

Hi again,
i would suggest that the solicitor sends her a photo of the rings if she is that concerned. She can then identify them. If she has jo clue why is she concerned? Why would you know?
Maybe say you can’t get there and suggest she gets a description off the solicitor.
I couldn’t say why she is behaving like this, maybe to get back at him for holding out so long? I would continue to try and distance yourself and just wait for things to be administered and distributed.

Things moved on very quickly yesterday, I spoke to the practitioner at the solicitors who said she still hasn't finalised the accounts although there's very little to do, she didn't know the executor had asked for the identity of the rings to be confirmed but would ask the solicitor if he was in the office, she was not sure where he was.. 2 minutes later the solicitor called me and said the executor had asked for the rings to be confirmed he then sent me photographs of the rings and I confirmed that they were.
Where do I go from here ?
This is madness, and remember it's my momwere talking about in all this.
Are all solicitors trained to lie?
It's ridiculous, where can I go to get someone in the Law to sort this mess and finish this nightmare?

If you’ve confirmed they are the rings then it’s no longer an issue. The solicitors will be finalising the estate accounts as there are no doubt final fees to deduct, there may be further tax to pay on any interest etc.
It seems it’s nearly there now the ring issue has been sorted.

Can you tell me why they have not done final accounts, they've had 2 weeks to make one deduction and send out. Surely just typing into a spread sheet doesn't take 2 weeks?
Why does an Executor not get them to hurty along, if as she says she wants it finished ASAP. It proves things can get done quickly as I did yesterday.

If I want to take my complaint to the Legal Ombudsman about the solicitors poor advice, lack of action and extraordinary excessive bill, well ove £15,000 now for an estate of £140,000 do I have to go through solicitors complaint procedure first or can I complain straight away to the legal ombudsman?

Hi,
You would need to go through the solicitors own complaints procedure first. I suspect they will say they were doing as the executor instructed. You are also not their client so I don’t believe you have a right to bring a complaint, I’m afraid.
Their client is the executor who it appears from your posts, has created much of the delay themselves, over the rings. Once the assets are collected they also need to obtain clearance from HMRC which can take time. They wouldn’t request clearance until the assets are all in and about to be distributed. Just thoughts about reason for further delay but could be any number of things.

No I can as a beneficiary make a claim against them,, only delays are so solicitors can Rob more money from my dead mom and dad. I see you take the side of the solicitors, No surprise there, all thieves stick together.
I will pursue a claim against them and I will win.
