  • Providing income details to solicitor?

    Hi
i am currently taking my ex to court for child support and financial provisions. I’ve contacted his solicitors to inform him and they’ve suggested a mutual agreement rather than going to court which is great.

they however want details of my own income for him to consider how much/what he awards me.

Our daughter is 7 months old, we split before she was born. He has a very good salary and multiple properties. He has been putting £1000 a month in to savings for our daughter (he owns the account) but refuses to give me any money or to help provide clothes, toys, food etc I work for minimum wage and because of this I can not afford legal advise or my own solicitor so I don’t know where I stand at all and advise would be appreciated.

Ive asked that he pays the child maintence standard calculation plus top up because his income is high as well as a lump sum to help me move and to account for the financial position I’m in because he has gone 7 months without paying anything.

theyve said in order for him to negotiate an amount and consider what I’m asking I have to provide details of my income and outgoings

is this correct? Why do my wages or what I spend my money on matter in regards to him paying for his child

They don't, he's not paying you he's paying for his daughter and frankly I would refuse.

Additionally I would have contacted the CSA by month 2 when it was obvious he wasn't prepared to pay and paid their £20 fee to get him to be paying what he rightfully should if there's a potential £1,000 a month on the cards. Why should you have to struggle to cloth and feed your daughter with him contributing nothing.

I think my response would be along the lines of my I&E are not relevant in this matter as he isn't paying me he's paying for his daughter to be fed, clothed etc. so jog on. Equally he hasn't paid for his child for 7 months, so unless 7 months back payment is fourth coming within 14 days of this letter and a regular payment set up in the interim of this agreement being finalised then I'll utilise the CSA to start obtaining what is rightfully his daughters.

Sorry to make assumptions, but as you say you work min wage do you perhaps get help with Housing Benefit? If so it may be the case you are entitled to legal aid and it may be worth contacting a local family law solicitor to see if you can and if so will they represent you on that basis. You may not, but better to ask and be told No than struggle through this when a professional could have dealt with it for you.
