  • Claim Form from County Court Business Centre - Lowell Portfolio LTD

    Hello All,
My name is Vikki, i had a Vodafone phone account some time ago now, after a few months the service stopped working properly and i had no reception or internet. I sent them numerous emails to complain and they were not interested. I did have an email from them saying there was a problem in my area. In the end i decided to just stop paying them. I have had letters from them and other debt companies and i have told them all the same thing that i dont intend to pay as they no longer provided me with a service. I am on benefits now (hopefully short term as my partner was made redundant) so i can only afford a very small amount. I dont want to pay them but if its easier as i dont want the stress then i will do. I havent seen a form like this before so dont even know if its real.

It has the claimant as Lowell Portfolie, the address of the court is in Northampton. It says i owe 344.88 plus 35.00 court fee and 50.00 legal costs. Any help of what to do would be appreciated as i have no idea.

This is a real claim, but based on what you have told us in your post Vodafone may have breached their contract with you by failing to provide you a service.

First thing is to Acknowledge Claim and then send them a CPR 31.14 Request. You need to ask for the agreement however they have worded that in their Particulars of Claim because the foundation of your potential defence will be on the terms stated in the agreement.

Lee Vodafone Company Rep may also be able to assist with what Vodafone have and given to Lowell.

You can remove that paragraph from the letter and you do not need to send a fee with the Part 31.14 request.

As it's a telecoms agreement there will be no Credit Agreement and so the CCA letter is not needed.
