    Hi All
    i am here looking for some advice following a recent credit file check.
    i wanted to check everything was ok before applying for a mortgage with my husband.
    imagine my surprise when I saw a pants credit rating and a ccj I knew nothing about!
    please help!

    to LB ... can you explain a bit more about what you need advice with please?

    How old is the ccj?
    Original creditor?
    etc...
    Debt is like any other trap, easy enough to get into, but hard enough to get out of.

      Hi Kati
      the date on the ccj is 2014.
      i’m unsure of the creditor but I think I need to contact the court to find this out?

      we have an aip with Halifax and have had an offer accepted on a house, am really worried now that the full mortgage application will get declined!

          How much is it for?

          You need to get the details from the court ASAP, so that you can write to the claimant and request their consent to set the Judgement Aside.           Once you know the address the claim was sent to and can fathom why you didn't receive it then further advice can be offered.

            Its for £754 which I will happily pay in full if it is an oversight on my part, but I just can’t think where I’ve forgotten something ☹️

              Hi again!
              okay, more info... the debt is to Vanquis, I had a card with them shortly before we had to leave our rented accommodation in the same year as the CCJ logged (2014), but am sure I paid it off. Not sure how I would prove this though other than trawling through old bank statements that I don’t have.
              we moved to my father-in-laws for a few months and then bought a house in my husbands name in August that year.
              I seem to recall the MA saying at the time that as we could afford the house this way, do it without me on the mortgage, because my credit score was non-existent at the time, thats why I got the Vanquis card, to try to build it up!!
              I currently have 2 credit cards that are quite high on utilisation, but are paid promptly every month, which is reflected on the credit report.
              Time is of the essence, so biggest question is, do I pay the ccj so that it is at least marked as satisfied? Or will this make little difference to my credit file?
              Are we likely to end up having our full Halifax mortgage application rejected now? Or should we just look at sub-prime lenders to be safe? I can’t lose the house we’ve had an offer accepted on

                How frustrating - you'll need to discuss the situation with the mortgage lender - if they recommend paying it to have it marked as satisfied as that will assist your application then that would likely be quicker than going through the set aside process ( that would take a good few months to get it set aside and removed from the register ) Can your husband have the mortgage in just his name again if his file is okay ?

                SAR to Vanquis and to the Judgment holder will help find out what happened in the history of this debt too - potentially you could look to sort it out after your intial issue is sorted

                  I am thinking of just paying it anyway, as then it will drop off my credit file sooner won’t it? Plus at the end of the day, if I owe it, I owe it don’t I ☹️
                  I like the idea of set-aside because I’m sure the process has fallen down somewhere along the line, but I just haven’t got the months to spare (although our sellers haven’t found anywhere yet, so it is tempting!)
                  But, am I right in thinking that if I went for set-aside but the judge didn’t agree, it would start a fresh 6yr stretch on my file?? Defo don’t want that!!
                  Last question, will a satisfied ccj & 2 well-managed credit cards (totalling no more than £1600 combined) look better than an unsatisfied ccj and 2 credit cards with low balances??

                    if you pay it it will not drop off so why pay it? it stays on there as settled but not removed, set aside not win then all reverts back to original dates, settled/unsettled makes no difference as we well know, no way out unless within 28 days a case is paid off after the CCJ stays for the term in question - there is no easy way out afraid

                      i don’t think I worded that last post very well, what I meant about the ccj dropping off sooner was that I appear to be already over half way into this ccj, so if I leave it alone it will drop off anyway after so many months, rather than ‘resetting the clock’ by asking it to be set aside.

                        drops off after 6 years or 5 in scotland that is CRAs only, but still owed if not paid off but not recorded there
