  • Double Glazing refusing to acknowledge cancellation.

    My elderly mother, shes 88 and does get confused easily. had a d/g rep sell her a new back door , £1833. she signed the contract on 6th Feb.2018. after talking to her She agreed to cancel the order.
    duly signing the cancellation slip and sending it on the 19th Feb. (recorded delivery) However the co. are saying we have only 7 days in which to cancel. and as they surveyed the property and door on 13th Feb we are obliged to fulfill the contract.

    i worried in case they turn up and fit the door, my mother is now disabled following a car accident. thinking i should issue a trespass notice and
    prevent anyone from the company entering our property...ok we may lose the deposit but £1833 for a back door.?

      The devil is in the detail, so you need to see what the cancellation term is in their policy. If you do not pay and they carry out the work then they can take your mother to small claims court, therefore you need to confirm to them that you believe you have cancelled so they should not fit the door as you will not pay them if they do.

      They might still try to send some scary letters, but as their only loss is surveying the property and they have had a deposit then they couldn't evidence a loss of £1,833 in court.

        The consumer rights regulations allows you to cancel an off premises order for goods from the moment you place your order and ends 14 days from the day you receive your goods.
        If they claim it is a service contract due to carrying out a survey, they shouldn't carry out the survey until after the expiry of the 14 day cancellation period
        The first day is the day after the contract is signed,

        Tell them to take a hike!
