    I have a dispute with a neighbour over a fence. This is now in the county courts, BUT this neighbour wishes to mediate by using a police station ( she claims to be afraid of me ) and if this is not acceptable, this person claims that any other venue must have a police prescence. I have refused this, but suggested if a "companion" is necessary, then why not appraoch charity workers, anyone connected a church, such as a deacon, vicar or priest, or ask the CAB for guidance. But can police officers in any way be allowed to fulfill such a role? So far, I have not received a response to my alternative suggestions - Blue Shadow

    Mediation in the small claims court is normally by telephone, the parties do not speak to one another.

    If you're looking at Alternative Dispute Resolution though that could be a face to face meeting with a mediator.

    Not sure what stage this claim is at, who is claiming against who etc, but where has your neighbour put this in a court document ( like a directions questionnaire? )

        I am taking neighbour to county court regarding garden damage, dispute over new fence ( erected by neighbour) position etc. Neighbour claims to want to settle matter, but has not offered any kind of compensation for large scale damage and then makes contradictory statements in letters, saying will fight this matter at every point. But whatever, I thought police should never in any way, be involved in civil cases - so again, can they or can't they? - Blue Shadow Date set for county court hearing

            I very much doubt it unless there is a criminal matter as well ( harrassment / violence etc ?) and I can't see they'd offer any 'space' or 'manpower' to hold a mediation meeting - on what basis is this mediation being offered ? Outside of the court process ? Has she made any criminal complaint against you ?

            There is no requirement to have a face to face - other than in the court room really - settlement offers and negotiation should take place in writing IMO.

              If they are offering ADR then the onus is on them to arrange it. Personally I'd just agree as when they go to the Police I very much doubt that they'll have the resources to be getting involved.

              If the Police were to be there while you discuss and try to resolve the matter what is your objection to that?
