      Have just recieved my letter from Natwest stating that they are following up on the complaints I've made, are willing to go no further as the point im trying to argue is no longer valid as of "Certain date" * people. If I DO not reply within 14days they will consider my case closed.

      Oh the words i would like to call these people, It feels like a cocky letter from them!!!
      ~Never has PPI refunds been owed to so many...by so few~

        I've not received anything from the courts stating that First Direct are applying for a strike out of my claim yet !!

                              pmsl he gets about a bit . Have a look at ' Burden of Proof under UTCCR ' on here most of that case law being discussed OTR is on there.

                              Also if u are looking at that route have a look at Article 4 mentions in the SC Judgment and the different countries implementation of the EU Directives, esp Spain, and as a forerunner to the Directive, Germany.

                              (not much help unless we/the government/the court/the OFT get a referral to the ECJ )

                                Note on burden of proof in consumer cases by Tom Brennan.

                                All the case laws quoted in it were discussed in the test case hearings.
