  • STAYED CLAIMS AN IDEA - Please post County Court addresses

    Hi all,

    I have been thinking about the fact that Banks have been writing to the County Courts requesting a blanket stay on Bank penalty charges claims and thought well why wait until cases are stayed before contacting the courts. I think that sites such as this should make their feelings about this fully known to the courts and one such court Coventry has I have heard written to the Banks in response to their request for all claims to be stayed and made the banks fully aware that each claim will be judged on its own merits on an individual basis. This is how the process should work and if our Banks apply for stays then it should be done individually, allowing us to then apply for these stays to be removed.

    I therefore thought it would be useful if on behalf of the members of this site we should write to the courts experessing our concerns prior to cases being stayed a strong letter outlining our reasons for not accepting the blanket staying of claims may do the trick.

    So this thread is really to discuss the possibility of Legal Beagles joining forces with other sites to:

    a) develop a standard template letter to be sent to each court we have details of posted by our members.

    b) to allow members somewhere to post details of the County Court they are using including the address of it.

    I am open for this idea to be discussed and if its thought to be a good one then fine, if its thought it woulod be to much of a chore then perhaps if a templated letter with logos from the various site was placed in the library we could post somewhere the courts that these have been sent to so we dont repeat the process.

    I will kick off the process with the details of my local county court.

    tanz, i think this is probably the best way to do this, strength in numbers, etc!
    something has to be tried, otherwise we are victims of the bullies, again!
    luckily, i have recieved my money from natwest, but was just about to start on Abbey! The lastest development, with the banks and the OFT, totally stinks!
    Cardiff is the county court that was dealing with my claim! not sure if they are staying! mia x

      I am already working on wording for this alongside the applications to lift stays. I'm doing this in conjunction with one of the mods from PC too and we are swapping ideas.

      I have an AQ for my claim and don't expect the stay letter from the court until this has been submitted (and they've pocketed another £100 of my money). I am working on a letter to go with the AQ rather than respond after the stay has been notified.

      There is also a thread by ICY running OTR saying what each court is currently doing re stays, though I'm not sure how accurate the data is.

      I don't know who else is working on these ideas, but clearly it would be better if we coordinated this for maximum effect. Frankly, I spend too much time every day checking up what's happening everywhere but then don't have the time to work on the results. I think a little bit of pooling efforts across a few of us would be VERY productive.

      Can't do more now but can correspond tonight. I'd be pleased to bring more people into the loop here and hear their comments.

            just heard today, my court has applied a blanket stay on all bank charge related cases! didn't even bother reading my bundle..... which contains an application for a rejection of any stay!
            I've been given an N244 and been told to apply for the stay to be lifted on my case, for which of course there is another fee (quite lucrative for the courts all this don't ya think)

            Thankfully due to the fact I'm on benefits I am exempt from any charges. tiss no laughing matter for those who are not though.

                  I phoned Bristol County Court yesterday, was told all claims are being Stayed, NO exeptions, not even if your facing repossesion. Because if the Banks win, there would be "come back on the Court"!!!!!!!. Surley the Banks would still get the chance to argue their case.
                  Nat West 1 £9k settled AQ stage.
                  Nat West 2 £126 settled LBA
                  HSBC practice run £1330.00 settled on the Court doorstep....almost.

                            Told today that Newport (Gwent) County Court is staying all cases regardless - a blanket stay. They didn't like being told that the Master of the Rolls had not granted authority for a blanket stay to the DJ

                            Noone has a clue about credit card claims and they were unable to find out for me.

                            They were happy to take another £100 for the AQ of course. This is a nice little earner for the courts now. If you made an agreement with an organisation for a service and paid them hundreds, then they decided that due to something else coming up they'll just put in on hold for a few years, then you'd have grounds to take them to court. Great when you're the people who are supposed to stop this happening isn't it?? The judges are laughing all the way to the bank.
