    The 5 Law Lords who'll hear the appeal wil be appointed at the end of May and it's still listed for the 23 June. There will definately be a public gallery.

    I've given the OFT a gentle liitle nudge on our questions as it's been 3 weeks since we asked them.

      EXE incidentally I met Eric in fact I met all of the Animals when they performed in Baileys Club in the NE during the 60s

                The FSA boards minutes for Jan & Feb would seem to add weight to the theory that another waiver extension isn't a given - at least in it's present form - beyond the point the OFT rule the charges unfair.

                The 22 Jan board meeting was held on the same day the waiver was extended and the decision to extend it appears to have been taken by the executive (the board) at the meeting, as opposed to the Managing Director for Retail Markets as in the past.

                Mr Pain's report and the following key points were noted:
                1. the successful negotiation with a number of firms to stop selling Payment Protection Insurance; and
                2. the bank charges case was close to an initial judgment; the complaints handling waiver ended on 26 January 2009; and the Executive was considering whether it should be extended.

                December Reports from the Consumer and Practitioner Panels


                The Board noted the reports from the Panels and the following points in particular:
                1. the Consumer Panel’s concerns about the bank charges waiver;

                The Feb board minutes could be interpreted as the FSA asking the banks to throw the towel in.

                1. the judgment from the Court of Appeal in the bank charges test case that ruled that the Office of Fair Trading could assess the fairness of the bank charges. The FSA would encourage banks to discuss with the FSA ways in which to resolve this issue

                  Would you not say that the later announcement as to the substantive issues was exactly what they did do, ie rather than saying if the HoL agree with UTCCR and wading through all of the banks' Terms and conditions that they would be happy with three of the banks taking the issue further to the substantive issues.

                      The answers from the OFT didn't give any indications at all on where they're heading. The reality is they're not going to tell us anything while the investigation & litigation is ongoing and really who can blame them?

                      We'll just have to hope the HoLs hearing gives us any clues. There could be a case management hearing when the judgment is handed down which could give us some direction

                              So there's no Hope in the Banks test case?

                              The charges coming in to the banking industry every day will more than pay the banks total legal bill for the whole test case so why wouldn’t the Banks want to "ensure Justice at the highest level"

                                Goodness me...just catching up on the details (well, too much to take in really! lol) I mean, I've been following everything in the news but I've missed out on all this excitement & info here...blimey!

                                My friend won a 'hardship case' against abbey (I only found out yesterday and don't know the details) I didn't even know about them 'til then....I feel so out of touch!
