Sonu - I have seen dozens of identical letters sent to people by RLP.

Since 2012, when they LOST spectacularly in court when they tested the theory, they (and their various retail clients) have not taken people to court.

They depend on people being ignorant of their rights and being very scared and ashamed. So, their nasty tactics are working rather well on you....

In 2012, when this site reported on their loss in court, they directly threatened this website and me personally using top London solicitors. We responded and published all correspondence and they never contacted us again. They are weak and rely on your fear to fuel their business model. Now you've found Legal Beagles you will get all the support you need and most importantly we will tell you the truth. xxx

thank you des8 please it's given me seven days ,, Im just scared ,, hope you understand ... I will post the nest letter again .. Hope u understand I never got in trouble with the law ,,, or broken any rules ,,,,

Sonu....... I can feel how upset and scared you are.
I lost track of this thread (I'm new to this forum and get lost!) so I never did learn whether the police had been involved over this incident, whether you received police warning, caution or charge...... so let me tell you that if you DID NOT receive any of those then you DO NOT have a criminal record over this.... ok?
Now, back to RLP.............. they're demand for £147.50p would need to be broken down, and I do bel;ieve that this would give RLP a rather difficult time.
Next........... any case would not go to a County Court but to a Small claims court, which is an informal version of same where you would get the chance to explain your difficulties to a judge.
Even if it got this far ........ which I personally doubt, imo, you could show the judge just how poor you are and s/he would then suggest a few quid to be payed each month (whatever) until the REDUCED demand was payed off.

I reckon that the stress of all this gets to most people and they pay up, just to be free of the worry. If it was me, I would demand a breakdown of Debenham's costings, claim that the way in which they display such expensive and loved goods is a clear provocation, especially since they clear their floors of customer service staff........... and then, in my last letter to RLP I would tell them that any case would be defended.

Then I would get on with my life, prepared to go to a most interesting half day, chatting to a judge. S/he would most probably send me and the RLP rep to a room to talk it over, and I would tell the RLP to take it forward to a small-claims day...... in other words I would get the experience out of the situation and to hell with RLP, stores which stash their shelves high with tempting products with few on-floor staff...... oh yes, I've read many a rant by senior police officers about the irresponsibilities of big stores........ one even accused a well known store chain of coming close to provoking crimes in their attempts to raise sales.

You see? That may well have happened to you. If RLP took it to a judge, and you explained your weakness in a situation where you felt provoked beyond reason to do something naughty, and now the store making up expenses to reach the £147 limit, I think you might find leniency.

I once heard that RLP's success rate is circa 57% and that they don't bother with the difficult cases. Maybe that's true. Maybe not. But me? I would tell 'em to take it to court...... and bring their breakdown with them!

The forum bosses might know ............ I don't think that the other sides' court and legal fees can be claimed from a defendant in a small claim....... could the experts answer this? If I'm right you have NOTHING to lose by going ALL THE WAY!

Thank you old badger if I wasn't scared about my job,, and going throught stress and embarrassment as we live in small town where everyone knows each other I would have fought this all the way ,, I don't want my name in dept company or dragged in court,, I feel confident when I read all the support here,, did you read the third letter , employers getting access to your details' this all worries me .. Yes I do think store encourages pple to steel, I spend £100 even month on buying gifts for days etc from that store, when you go in there still they make you feel awkward watching you,,, that week I had a lot of life's stress and I went to town picked up a few item looked up .. I'm being watched,, so while he was watching I changed the labels, I didn't think of the outcome.. Now look at me ... If my so called friends found out they would curse me so badly ... So I can't even talk to any one...

I do agree with them that you are best to ignore these letters (Rlp will soon tire of them IMO) but at the end of the day, the choice is yours to make - all any of us can do is advise xx

I know that you are worried about Rlp taking you to court, and that seeing these 'cases' posted on their site early this morning has scared you. But ... have you noticed the dates on them?

The last "Update on Court Cases" by these :censored::tape::censored: was in May 2012!! That is over three years ago :nod:

Rlp DO NOT take people to court ... and they haven't dared suggest to a retailer that court is the answer since they spectacularly LOST in court

An interesting (or at least I find it interesting) point is that in none of the cases quoted have RLP given the claim number, and in spite of their assertion
"Transcripts of the Judgements have been requested and will be available in due course." no transcripts have ever been furnished.


It seems to me this was an early clumsy attempt by RLP to limit the damage done to their business model by the "Oxford" case.
No further cases have ever been reported as far as I can ascertain, and it has not been possible to verify the truth of their "Update on Court Cases"

How about a complaint under CPUTR ? who enforces the CPUTR ? Trading standards... so complaint to Trading Standards Nottingham I believe.

Unfair payment collection
33. The Regulations expressly cover all commercial demands for payment. Debt collectors acting aggressively and receive the consumer payment on their own behalf would be covered as “traders”. If the debt collectors are acting as agents of a trader, the claim would instead be against the trader. Businesses undertaking so-called “civil recovery” which receive payment from consumers accused of shoplifting could count as “traders” under the Regulations. In such cases the “product” purchased by the consumer is the settlement of actual or purported liabilities.

the Consumer Protection (Amendment) Regulations 2014 will amend the Consumer Protection from Unfair Trading Regulations 2008, extending the definition of a ‘transactional decision’ and giving consumers new private remedies where a trader uses misleading or aggressive commercial practices. And guidance on the 2014 Regulations (copy attached), published by the Department for Business Innovation & Skills (BIS) on 14 August, expressly states that, as a result, civil recovery “is now clearly covered” by the consumer protection regime established by the 2008 Regulations.

The Regulations amend the definition of a “transactional decision” to expressly cover demands for payment from a consumer in full or partial settlement of the consumer’s liabilities or purported liabilities to the trader (see reg 2(1A) of the 2008 Regulations). This means that misleading and aggressive practices in respect of such demands would now clearly lead to both criminal sanctions (under the 2008 Regulations), as well as private redress (under the Regulations).

For example, so-called “civil recovery” where a consumer is accused of shoplifting, and is asked to pay a standard fixed fee to avoid prosecution, can fall in this category, is now clearly covered.

The problem of course is that the majority of people who would have to bring the action are probably feeling vulnerable, and the last thing they want is to ratchet up the action.
They just want it to go away.
Having done something of which they are probably ashamed I doubt many will want to take on civil recovery firms, no matter how just their case.

This is also a very old template letter as the limit for small claims, which is what they are suggesting, is now £10,000 rather than the £5,000 they state.

They also state that getting a CCJ will also impact you getting credit in the future. Not quite true. Only if you are found guilty AND only if you fail to pay the judgement with 1 month.

So they are still lying.

Sonu, I know absolutely jack about your legal position but do not worry, some of the best in the country are on here sorting out that side of things. What I do know is that it is quite natural for you to feel like this right now. Naturally you are going to feel embarrassed – we all know you should not but- this has been an absolute nightmare so you will feel like you will never feel comfortable again.
Well, hey, guess what…..you will. There is no magic formula or show stopping phrase I can say to make you feel instantly better but I know that this feeling of terror will fade to mild embarrassment and although I will not stick my neck out and say one day you will laugh about it will be something that you will forget about.
The legal beagles on here have helped people who have faced bailiffs banging on their door and court summons’ coming out of their neither regions and ……won.
Now in your situation a few minutes trawling through similar posts should reassure you so don’t just take my word for it.
Every day in your life is precious so please do not let these jokers take a single smile or a moment’s peaceful sleep from your life. Oh and if you think this is the worst thing you have ever done or had to face then you will have a life that many would envy.
