  • MKRR texts and calls...

    Hello everyone.

After trawling various threads and getting confused I thought I may as well ask directly for help.

I have been getting calls and texts from MKRR for the last few months. I signed up to noddle and have found a defaulted account which I assume they have bought from my old Bank (halifax).

The long story shortened; In 2010 I was was to repay my student overdraft of £2000 in full which I couldn't at the time afford. I had to wait until I had been moved to collections so that I could set up a payment plan which I did after speaking to a debt advisor. After several months I got a phone call from Halifax saying my payments had been stopped so I had been charged more interest - I hadn't stopped the payments so asked for the charges to be taken off as I was still unemployed and I had done nothing to stop my direct debit (so assume something went wrong their end). After long phone calls and many tears I gave up trying to talk to them and buried my head in the sand hoping to pay it off once I had a job.

I know this wasn't the right thing to do but I suffer from mental health problems and couldn't cope with it, please no telling off

I talked to a debt advisor last week and they have sent me a pack including my budget sheet which shoes I can't afford to pay a thing as I'm homeless and on jsa having left uni due to illness.

Should I just send that to MKRR or should I ask for proof??

Any advice would be much appreciated.

    Thanks

If you are being harassed by those guys you may want to look at this thread and send them the letter posted on there: http://www.legalbeagles.info/forums/...om+harrassment

We don't tell anyone off, we are here to help, not to judge:beagle:. Some of us also have debts we haven't paid since 2010.

I assume you didn't make payments after 2010 from what you say above. If so, this account wouldn't be statute barred yet but it has around a year or so to run, possible a little longer. Debts become statute barred when there's been at least six years without payments or written acknowledgment of the debt. Although the arguments put forward by the debt advisor are very sound, sending them the pack you mention would very likely constitute acknowledgment of the debt, meaning it wouldn't go statute barred next year.

On the other hand, sending a prove-it letter does not constitute acknowledgment so you may want to start with that one first and say what they come back with. :thumb:
