            I got the letter & forms, thanks.

            The forms are obviously the preliminary questionnaire for determining if you had any PPI that may be reclaimable. They don't relate to any specific claim.

            On the letter it begins by saying ''Please find enclosed the replacement documents that you requested''. Then further on it contradicts this by saying ''We understand it can be frustrating completing these forms however it is a requirement of the lenders and the Claims Management Regulator requires that we follow their procedures, which can often mean the same form(s) needing to be completed at least once every 6 months so that they are up to date''.

            Can you confirm that you didn't request the documents? (I'm sure you didn't but just want to be sure).

              Formal Complaint

              We wish to make a formal complaint for which I expect you to issue a final response to within the 8 weeks provided for under the complaints handling rules of the Claims Management Regulator and your own complaints handling procedures.

              We would like to make clear that should we not consider our complaint to be fully resolved within the above timeframe we fully intend to take our complaint to the Legal Ombudsman.

              The subject of our complaint is the invoice for £393 you are seeking payment of and for which you simply describe is for ''breach of contract''. We deny any liability to you in respect of the invoice.

              As you will be aware we contacted you on 3 June requesting a copy of the alleged signed contact for which we have received no response.

              However we did receive 2 sets of forms (your own PPI complaints form and the FOS PPI consumer questionnaire) for which your covering letter wrongly refers to as ''replacement documents that you requested''. We did not request these documents from you. The letter then goes on to state, again wrongly, that these forms are ''needing to be completed at least once every 6 months''.

              It is our belief that you are engaging in a form of speculative invoicing similar to that experienced by other individuals at the foot of this complaint. We understand that the Claims Management Regulator is concerned with this issue.

              In resolution of this complaint we expect you to cancel the invoice and issue us with a written apology for the stress and inconvenience you have caused and we wish to repeat that should you not do so within the 8 weeks time frame we fully intend to take the matter to the Legal Ombudsman.

              They are now (in writing) accusing me of Breach of Contract for not signing Letters of Authorisation for them to proceed and have issued a hefty invoice for £750!!! Very Dodgy indeed.               I find myself in the same situation, In 2012 i was contacted by Bank Smart saying they could claim back my PPI. So i sent all the forms back and details that they asked for and waited, and waited, and waited and waited. Then they kept on sending through letters asking me for information that i had already given them, i ignored the letters, after a few more arrived i wrote back to them, and to make sure they got the letter i took o copy to their offices in Shelton street and put in in the letterbox (I only work around the corner) On Thursday of last week i received a letter telling me that i owe them over £500.00 for all the work they have carried out so far on my case, they are charging me for letters, and emails (Which i never received) this has caused my myself and my wife a huge amount of stress (I recently had a pacemaker fitted) and i don't know what to do, or who to turn to.

                      If you check through and send that letter yourself to Bank Smart - it should put you in their complaints process which will mean you can take it to the LegalOmbudsman after 8 weeks (or their final decision)

                      Add you address and any reference numbers on to the header of the letter and send it by post.

                      I've removed your phone number from your post - I'm sure you get enough junk PPI & personal Injury calls as it is, you don't want more. (edit: Kati beat me to it )

                          Good news today for one BankSmart 'customer' - they have not upheld his complaint yet have offered to cancel the invoice and close the account. Which is a win in my book.
