In this month news letter we have the following articles.

1. THE OFT
The OFT has been battling it out in the courts for number months now, we are still waiting on the Judge’s decision on the Banks old terms and conditions.
It was originally thought that his judgement would be made in July 2008. We don’t know if the delay has been caused by the complexity of the issues and or the amount of documentation that the Judge has to consider, maybe his other commitments have delayed matters. Either way as soon a we hear the information it will be posted in The Test Case Forum section.
Since July the OFT has issued a number of Question and Answer guides for consumers, we would like your feedback on these as consumers. Do you find them helpful up to date or lacking? We want to hear from you.
The OFT has also issued as Personal current accounts market study we have a full copy on the forum and we would like member feedback and suggestion we will then be submitting this to the OFT. We at penalty charges did not attended a recent meeting with the OFT however we are glad that a least one site attend. (Maybe the OFT was worried about inviting PC being the founding site behind the bank charges campaign. We note that Which and the CAB were also invited to a meeting with the OFT.
Penalty Charges has already attended two Meetings with the OFT one many years ago when Stephen Hone Organised the first protest outside the OFT to try and compel the OFT to take the legal action it is now doing. Penalty Charges found both meetings to be very uneventful as the OFT kept hiding behind Acts, and would never commit to or disclose anything.
Even today the OFT have not disclosed information requested under the freedom of information Act. A point that one of our members has now taken to the Information commissioner. We submit simple question were asked of the OFT but to date most if not all have been avoided, be answered at all or to our satisfaction. (what has the OFT to got to hide we ask)
Penalty charges will be writing to the OFT as we want to encourage the OFT to apply some pressure in respect of the Wavers that are still enforce, and if needed then the OFT should make an application to the court that the continued granting of these waivers must stop or banks must be stopped from charging too.
2. FSA (The Wavier)
Penalty Charges is considering organizing a large protest outside the FSA office at 25 The North Colonnade, Canary Wharf, London E14 5HS. Just before Xmas (date to be confirmed) we would like to encourage as many members as possible to spare a little time and join us in a united stance against the FSA waivers. (we say Protect the consumer first) If you interested please let us know at on the following link ( if you another consumer site and like to join us please let us know)

The protest will be on two points firstly that the Waivers should stop or the banks should be stopped from applying charges to consumers. Consumers are already struggling and yet the banks keep applying these charges. Unlike the banks, the consumers don’t get bailed out by the government.
We would also like to see the FSA stop the banks paying themselves huge bonus when they had to borrow (given) tax payers money due to their errors, clearly the taxpayers money used to bail the banks should be a last resort. And the bonus should be the first resort or was the tax payer money used to pay these bonus, a question members should write and ask there local MP. Either way consumers should not be paying for the banks errors whilst the banks pay the chief executives million pound bonuses.

3. Running Total updated
We would like to apologise for the delay in adding an over 600,000 thousand to the running total this was caused because by a technical glitch. We have now solved his problem and the total is up to date once again.
4. Great success on Consumer Credit Agreements
One of our members who was being hounded by a debt collection company for the last year, he had event been threatened with a statutory demand, well he has now had over £7,500.00 wiped, as the bank failed to supply the credit agreement and or show that they had any legal grounds on which to pursue the alleged debt.

We asked the Debt collectors why that had not checked that they has the legal grounds to chase the debt before they started, clearly chasing and unenforceable debt is wrong. One response they provided was; well they said it was owed. We submit that this leaves debt collectors open to chase debts that are not even real and potentially open to abuse. (Think of the elderly and the vulnerable faced with a letter say you could face losing you home if you do not pay) must would just pay out of fear, even though the debt might not be owed or be enforceable.
Penalty charges will be writing to the FSA and OFT and local MP’s to call for tighter controls on debt collcting companies.

Penalty charges has a huge General Consumer forum which covers most if not all areas of Consumer law, we even have a fantastic Traffic Offences forum which run mainly run by our very Traffic Watchdog “sammyferre” Thanks Sammyferre.

As was mentioned above our excellent consumer law section, covers everything from private contracts to tenancy disputes, through to misrepresentation through how to deal with a DCA in a firm manner! - If you have a problem or just want to learn your rights then please have a look, there are many sources of information that one can browse at one's leisure!!
If that’s not enough law, then feel free to track the case of Hone v PayPal. Our boss is taking PayPal to court for various reasons including PayPal meddling in a contract between the buyer and seller!

Court Proceedings have now been issued against PAYPAL an (eBay company)
We have seen a number of complaints against PayPal just refunded buyer money when there has been a contractual dispute between the buyer and selling. We have asked the court to make a declaration that in contractual disputes between the two parties (buyer and selling) that PayPal has no legal standing to intervene by refunding the buyer money, clearly is there is a contractual dispute the only person who has the power to order a refunded or make an award of money is a Judge at a Court of Law.
7. BIG NEWS
On the 1st October Penalty charges will be launching its sister site which we hope will be used by millions of consumers and businesses from around the world. The site will be launched on the 1st October but the doors won't open until the 15th October 2008.
