    Hi All
    I am fighting both FP & Elderbridge, currently at the court stage awaiting direction, hopefully mediation. They are rogues and will push you to the limit. Plan your arguments carefully and do not stick to one argument. CCA s140 & UTCCR amongst others.
    Also note that in FP accounts they state £5m provision for FOS ongoing discussion, (page 2), and Pages 20 & 21 other provisions state due to CCA non compliance. Why is this all there if they have done no wrong???
    By the way if you fight it be prepared for high legal costs, my advice do as much as you can prior to this, but you will need legals at some point I guess, some have managed without, I don't know how though!

      Hahahahah Complaints, they dont even know what a complaint is at Elderbridge, they are inept at best bless them,

      I actually have the chance to challenge them in Court in the very near future, so fingers crossed we can get them before a Judge, if we can then im pretty sure that it will be very interesting. They also from what i can recall do everything they can to keep Barclays out of the frame if it ends up with Court

        Let’s see who gets to court first then, 15 Feb my deadline for directions. Currently they are deny deny deny mode.

        i have Barclays and Elderbridge listed in my claim.

        we are using king chambers for counsel.

              Martin Budworth is excellent, i worked with him on the test case of Harrison v Link Financial, and also Mal'ouf v MBNA, he is a very very very good advocate, Adrian is not someone ive heard of, which is surprising given my connections with the north, the guys i would have expected you to have been using were Dr Nathan Smith or Martin Budworth, those are the two well known CCA guys there.

              They also have Kelly Pennifer, she is good, i worked with her in the Court of Appeal case of Kotecha, all links to those cases are in my signature

                GOSH I hope it does go to court Elderbridge do not imo play by rules . My case was GE to Elderbridge .. but same ethos but they know you don't have funding to take to court and wait years on FOS response ... lets hope something gets moving it took media to destroy wonga yet still lots of similar companies trading yet a company mistepresenting rates charges ignoring complaints .. refusing payments turns out thy miscalculated n charge nothing no apology no refunds .. carte blanche apoarently .. so please update this post.. court result or out of court admission surely have reprocussion for us all?

                    Unlikely, County Court decisions arent binding, ive had a case widely reported called swift v daley, that was on unfair terms and still even today swift argue that its wrong and not binding etc
