  • Joint bank account with cash card

Friend’s mam has died with no Will. No property or anything so should be fairly easy to sort out.

Husband and wife had a joint bank account. Now I know he just needs to go into the bank with the death certificate to get her name taken off the account, but my question is about the cash card. Their son has the cash card and isn’t very trustworthy. In fact he’s been known to help himself to cash before. What is the legal standing on the card? Is it meant to be cut up, returned to the bank or what? Want to do whatever is necessary to make sure said son canny use it.

Another thing, he found a good amount of money after rifling through his mam’s stuff (over £1000). Which should obviously be used towards funeral expenses. He’s now denying any knowledge of this money. His dad is really frail and can’t really stand up to him. Can anything be done or said about this?

Awful how how death brings out the worst in people.

Ask the issuing bank to cancel the cash card.

Viewing the circumstances regarding the removal of the money I doubt anything can be done.
Is there any proof the cash existed and that the son has taken it?
And if there is would the father actually be prepared to take action and report it to the police?

Just to follow up what Des has said, the card in her name should be cancelled once the bank is informed of her death with the death certificate. The theft of money especially under these circumstances is very very hard, to be fair. I'm not sure I can offer much advice on that one unfortunately.

I can't really add anything further to Des' post #2.

Get the bank notified ASAP, they'll immediately cancel the card rendering it useless.
