  • Debt owed to nolans law

    Hi hopefully someone can give me a bit of advice, I was planning to seek advice from the citizens advice but there is none in my local area.

    Around 2 years ago I took out a payday loan with likleyloans which I will be honest couldn't afford to pay back.
    It was then passed to Cabot finical and now to nolans law.

    Nolans took it to the sherif officer who let me pay it back in installments of £20 per month I paid this for 6+ months threw there online website when really I should have set it up a standing order, I missed a few payments and they said the agreement had been cancelled and wanted me to complete a expenditure form.

    I have done thdone partner, myself and two kids are left with £151 per month nolans are demanding £75 of this or they will be taking further action and won't take any of my offers lower than this which there is no way we can afford with the cost of living.

    They seem pretty heartless in there replies, I thought as long as I made an offer they where not able to take things further?

    Hopefully you knowledgeable people can give me some advice, thanks

    Nolans are tenacious with debts. Was a CCJ awarded by the sheriff? I'm going to guess so. The fact that you defaulted on the payment means you are now a Nolans mercy, of which they have none. Do you own your home?

          Hi sorry for late reply.
          I don't own my home it's a private let we stay in, I have offerd them £30 which is all I can afford but they are still demanding £75 per month, I have just received an email today asking for me to pay them or I quote "
          If we don't receive the payment of £75.00 on 23/03/2023, we will be instructed to proceed with enforcement action."

            Try to stay calm.

            They don't seem to understand. You've sent them an income and expenditure form, explained that you can only afford £30 (I think you should have offered lower, £10 per month, there is a cost of living crisis, energy, food etc). Also you have children, so what they are asking for is totally out of order.

            Send them the following template, amend it to suit your circumstances. Make sure you get Proof of Postage. Make sure you include that you have young children, your work circumstances etc. Make sure you tell them you have sent them an income and expenditure as per their request.

            Write 'CC. Law Society of Scotland' on the template.

            Email a copy of your letter to the Law Society of Scotland -

                    Who is the Client they refer to? When did you fill in the Income and Expenditure form they are talking about?

                      There client is Cabot financial but originally it was likleyloans I took the £1000 loan with.

                      The last expenditure form I sent was around 8 weeks ago now.

                        Email your complaint to Cabot Financial. (You are emailing a covering letter, a new I & E Form and the letter emailed to Nolan's Law with a payment offer).

                        Fill in a new Income and Expenditure form, take into account the unpredictable costs of living, utility, food, etc, but give yourself a 'buffer', remember you can't predict 'cold snaps'. Explain that you didn't do this in the previous Income and Expenditure form.

                        What you need to do is write a covering letter.

                        Explain that because you have been unable to come to an agreement with Nolan's Law, you are writing to them (Cabot Financial) as a last resort before you lodge a complaint with the Financial Conduct Authority. Add that the FCA has stated that 'vulnerable people' should be 'treated fairly'
                        in the current 'cost of living crisis'.

                          Hi just a little update, I did contact Cabot financial but have not heard back from them as yet.

                          Today I received another email from nolans but not sure if I should tell them I have contacted Cabot directly?

                          I note we have not yet received your payment due on 23rd March for £75.00.

                          Therefore you are now in arrears of £75.00, please provide your proposals for repayment of the arrears outstanding.

                          Please note your next payment is due on 23rd April 2023.

                          I look forward to hearing from you within 7 days.
                          "
