        Hypothesis:

        One day someone decided he wanted to get rich quickly. The idea slowly formed of making a passport website and getting consumers to pay substantial funds online for substantially worthless services.

        At this point he needed help and a conspiracy was started to develop a website to provide substantially worthless passport services but the all-important issue was to comply with all legal requirements and ways had to be devised to do this to avoid problems with the authorities. A great deal of legal time was spent to achieve this end.

        As part of the scheme, active debt collection systems had to be put in place to chase up any consumer who felt he had been scammed and cancelled his credit card payment.

        At this point we have a website offering these services which, apparently leaves consumers with little redress/defense in the event of court action for debt recovery in the county court.

        However, in the county court, a defendant has only to prove to the extent of 50.1% that his defense is valid for the recovery action to fail.

        If the court can be persuaded 50.1% that, from the outset, the intention was to effectively defraud consumers by providing substantially worthless services then, perhaps, all that flows from this hypothetical outset is at least voidable and possibly void. Recovery would then fail.

        So, how to demonstrate this to the court?

        The website can offer opportunities. There may be explicit disclaimers and methods used to take away consumers' rights - all perfectly legal, no doubt, but which, nevertheless, might give an insight into the intended business model.

        There may also be a number of complaints from consumers and the website operator (and also the server if the website is hosted externally) will have a record of these.

        A simple request to the court for a disclosure order would reveal the number and content of these complaints.

        There is more that could be done in calling the owner(s) of the business as witness(es) for [cross] examination.

        None of this would be without some financial risk but life is a risk isn't it?!

          That sounds like a pretty fair summary there falang.

          Maybe you could surmise why the Debt Collection Activities began in November, charges were only added to the ''customer'' invoice from January onwards and court claims bought against people regardless of whether they first encountered the website last June or this January, oh and of course that the accounts are due at Companies House in May.

          It may be a game or an experiment to the 'business' owner, but for the people who have been caught up in it, it is not.

            Maybe they were just perfecting their systems.

            Part of the system can be that eventually the "debts" can be sold on at a discount and consumers then have to start again with a new debt collector.

            Is there anywhere in this forum where actual court proceedings and the results of trial are discussed.

            It would be interesting to learn of any successful and unsuccessful actions.

            I should perhaps declare an interest here in that one of my children is facing issues with this business. I have a copy email where BPS state "You appear to be dealing with a rogue agent at the Passport Office. We have run into one before who called us a “scam”. "Rogue" has a number of dictionary definitions, one of which is "dishonest". I'm not sure that HMPO would take kindly to it's employees being referred to as "rogue". This seems potentially litigious and I am mulling whether to pass this on to HMPO.

              Yes, please do, we have other's who have received the same - have BPS sent you a copy of the ''apology'' from the HMPO ? They do actually have it published on their website (BPS that is - I think on their latest-news.html page )

              There haven't been any full court proceedings with BPS. All the Judgments on their website are DEFAULT judgments, if they exist at all. It is only since January we have seen people with county court claims against them, which would be very unusual if people have been having court claims since last June as alleged there is not a single one who has asked for assistance across any of the support forums ( other than their own fake one )

              I don't doubt they are still perfecting their systems. They have a way to go yet.

              Has your son/daughter received a county court claim from UKS&S already or just receiving the emails/texts chasing money ?

                Okay the phone thing was bugging us so we just rang the HMPO on their proper number 0300 222 0000 and made an appointment for the 20th for a 1 day service. Took 5 mins and we got a text confirming the appt straightaway.

                We should set up a website and do it for people at £117.60 a pop lol.

                The text is sent from id of 'passport' and anyone can set their ID to be 'passport' and that's how the texts all end up in the same 'thread' on newer phones, I suspect it would be different on a crappy old nokia.

                  I also just changed the name of my daughter to "Passport" and asked her to text me the exact same wording I got from HMPO, sure enough it came through with the ID of "Passport", the sender can send an SMS using any ID, therefore they would always end up in the same message thread

                          This is all good news. So, we now know that Howard has actively changed his SMS sender name to 'Passport', exactly the same as HMPO. This is irrefutable evidence of trying to pass BPS off as HMPO - after all, any GENUINE business would want to AVOID being mistaken for another company in the same market.

                          Another nail in the coffin, hopefully. The cremation's long overdue now.

                            You could even do few deals.... Buy an appointment..... Get off a parking ticket free!! :tongue2:
