Hi all

I think I might have started this thread, I have been on holiday and just got back, before I left I received a claim for from the Courts "money claim online" I then went online and click defend or reject this claim. Within the particulars of the claim they note my ip address, and run through the service they supposedly supplied. Now while I was away I received a notice of proposed allocation to small claims track.

So basically I am at that stage. Does anyone else have an outstanding claim? Mandid? I think you are in the same boat.

I guess the question is NOW WHAT !!!

It sounds like the particulars of claim are similar to the other 4 or 5 people who we know have had a claim.

Have you acknowledged the claim and have you entered a defence yet?

It's wise to state you're prepared to mediate and you can say that AND say you intend to defend the claim in full. Mediation is done over the phone.

I thought I had email notifications turned on, One just came through! I thought no one was replying and now there are 23 PAGES !!!!! bloody hell, its a monster. Not sure what is up with that, anyway.....

I did enter a defence with the online site I did that in January, I said I intend to defend said there was no proof they booked an appointment etc etc. The mediation forms came through while my parents were on holiday and I think I have missed the date, my mum rang them (that sounds sad as I am 40 but I live abroad!!! :tinysmile_twink_t2 and they said to email them immediately and my mum scanned some mediation documents. so you are saying I should fill these in scan them and send them back to the email address provided????

If 4-5 of us are in the same boat would the courts decide to hear our cases together or does it HAVE to be at our local court. As I say I am an ex-pat (immigrant with a porsche) so I live outside the UK, so attending Court would be quite costly. I also don't want a CCJ as I want to get a mortgage soon.

You probably missed the first email. It then doesn't send any more for that thread until after you've been back to the forum again, even if there are other replies in the meantime.

I can't imagine BPS would say yes to mediation ,but worth a try.

If I said yes to mediation and BPS didn't, would it look good on my part in court as I showed I was willing to settle the matter without court? Or does the mediation have no bearing if the matter gets to county court?

Saying yes to mediation ALWAYS looks good (even when it won't/doesn't work)

Also mediation does not imply that you think your case is weak or that you are prepared to give ground if you are not.

Thank you EXC and Kati, I was going to fill out the N180 later and tick no to mediation as I thought BPS would not even consider it. Will definitely say yes to mediation.
