    Would you recommend holding off on sending the n180 for now? Probably best to get as much info built up as possible.

    Will email HMPO later tonight at work and ask for an email showing the appointment that was booked by "****** *******"

          N180 usually comes with a letter about deadline for filing - usually 7 days plus.

            I think that would be a good idea. Get as much info as you can from the passport office in writing. Who booked, when, who did they say they were etc etc. Maybe ring them and explain why you need it.

            Your defence isn't terrible Okay its not got much in the way of legal argument so that will need fixing later but its a clear description of exactly what happened.

            Its good news that you didn't have a contract emailed to you other than the link - actually can you check if that original link they sent you still works or if they have changed yours to surnameinitial@signedcontract.org.uk/uUSERID as they have with others.

            I'm not sure how they are booking the appointments - if they are pretending to be the ''customer'' to book an appointment for ''themselves'' or are booking it on behalf of the ''customer'' - to me, in your case, it sounds like a woman was doing the 'make an appointment' calls that particular day and had to come up with a name, maybe pretending to be your relation or something.

            We're just ringing the passport office again to find out what their actual rules are on booking urgent appointments.

              Yes I submitted the full defence via MCOL, I used 219 lines out of 221! had a lot to say.

              The n180 has a deadline of 24th of February I believe, haven't got it to hand as I am at work.

              Once I have filed that, does the claimant still have the opportunity to drop the case before the court date? I believe they can cancel for no extra fee (apart from the £25) if they drop the case at least 7 days before the court date? is this correct.

              I have emailed HMPO asking for an electronic copy of the appointment that was booked for me but apparently it can take up to 20 days to get information back. hopefully they can supply me with the details.

              Do any of you guys on here know of anybody who has gone to county court with BPS, or has everybody else only had threats so far? I'm not bothered if they do take me to court as I believe I would win the case, but just curious.

                Yes indeed they can. They can return the N180 and pay the hearing fee and get it refunded if they cancel 7 days before the hearing. (grrr)

                Ok, they might be quicker but you should have 20 days from submitting the N180 really anyway as the case then gets transferred to your local court and they then issue directions or a hearing date.

                I don't know anyone that has actually gone TO court with BPS - or anyone actually so far that's any further with it than entering a defence. All the claims they detail on their website are Default Judgments (where people just haven't responded to the claim form) and they of course aren't going to talk about any where they pulled out themselves, or lost. We know they have one judgment against them from their old company name but don't know any details of that.

                  Thanks! I hope somebody see's the human side of the argument rather than just the legal side.

                  Also, in regards to your point with the contract, I believe I read somewhere in this thread that a contract must be sent to you in a specific manner (e.g. email or hard copy etc) before the work is carried out. Is this correct? Would that invalidate the "contract".

                    Yes, if you hadn't received the contract in a durable form it will help the defence.

                      Ok that's good news, I very much doubt they want to take anyone to court as they must know how many loopholes can be picked in their contract/methods. It may still all be scare tactics to see how much they can push us.

                      I feel very sorry for vulnerable people out there who have probably payed up due to the numerous threats.

                            Hi - URGENT re British Passports UK - any help gratefully received. This is my first forum post of any kind, took me a while to figure out how to do it. I have found some really useful information on your site re UK Passport Services. Before figuring out how to post I have already found an email address and emailed you.

                            Long story short: my son has just received a court claim pack from this company. Like others on this site he accidently found their website, filed in a form then crashed out of it before nay payment was made and forgot about them. Three months later we get demands for payment from them. Ignored the first one, replied in depth to the second, third one received and now a court claim.

                            We have to the 18th Feb to send off the form to the court. I would appreciate any support/help with this company. Really pleased to find a link on your site to the ASA ruling against their website but I am not legally trained and I am afraid of thins going against us.
