Hello All,
Just need a bit of guidance and questions answered. I am not very clued up about the legal system hence me coming in here.
I was working for an employer from May 2017 up to January 2018. In january 2018 my manager called to tell me the area investigator wanted to see me in the office. So no information was given at the time but i attended thinking it was just routine checks.
Upon arriving i was interviewed about allegations of fraud by him and his colleague. the interview was recorded. Now i answered all questions they asked to best of my knowledge etc... at which point i was suspended pending a hearing, strangely they allowed me to keep company mobile phobe which ironically had all customer information even though they saying i have stolen between £8-10k.
Now i have never committed fraud in my life so this whole instance was a mahor shock to me. Acfew days later i received a pack in the post with all "evidence" they claim with transcript of my interview along with the date of my hearing which stated i could only bring a member of union with me if i was part of one and no family or friend of legal body. i went alone to my hearing was dismissed under gross misconduct of fraud though i gave my side of events and fought my corner alone against a HR director and another manager. I been claimed to have been put in CIFAS which i dont think they have pursued either since also the evidence they have only brought forward is three hand written witness statments from three people i have never met or never met me...
In July 2018 (6 months) later i returned from a family holiday to a letter from a solictor that represented the company basically stating i need to attend an intervuew under caution and so forth. At this point i spoke to few people in family one of whom owns their own law firm and they told me to get a solictor for defense and represent me to write letters so i did this. Now i went and spoke to my solicitor and have stressed i have not taken the money they accusing me of and took all the documents they sent me. My solicitors wrote tocthem requesting more information and evidence. We are now in July 2019 and not a single letter reply from them.
How long can a case be left open for? Because surely if they was certain i took this they would do everything possible to claim it back but not even a single response seems a bit odd.
How long do i allow before asking my solictor to request compensation for various reasons ?
