  • Nissan Qashqai purchase - Section 75

    Hello all,

Sorry if this seems all over the place - Stressed out isn't the term however here we go.

I bought a 2014 Nissan Qashqai from a auto store Peugeot Dealership - They explained that the car had 7800 miles on the clock - it wasn't until i had driven away did i realise it was actually 8000 miles however I drove 300 miles back to my home with no issues but 7 days later Engine Management Light (EML) emitted and the car was taken home. Personal OBD reader was placed on the car and P0202 code was admitted - I contacted the dealership and made them aware - They said "go to any garage, near to you and they will do the work under the warranty". It was booked in for two weeks later with a garage who would undertake the work (BMW/MINI) Specialist and they agreed that it was a injector fault, warranty agreed to pay however, there then transcribed that their was a sensor fault, throttle assembly fault (warranty agreed to pay) and then an ECU issue - they had noticed the ECU wiring loom wires had be spliced and they stated this could have short circuited the ECU and caused it to be faulty...

Now i contacted the dealership and stated that i wanted the car to be collected how they stated to wait until the warranty company had seen it, they had and produced a report but refused to cover the ECU costs/repairs, now this is where i may have gone wrong, I am an OT in social services, I needed a car - i paid for the ECU to be replaced and coded - this was completed on 11th November and up to today (touch wood) car is working and is great.

I gave the garage a right to repair but they pushed me to the warranty route and now they are refusing to get involved and say it's not their fault. I explained under Consumer Act 2015, the car was not fit for purpose, satisfactory and until these repairs - the car is now working. I have asked them to pay for the ECU repairs but they explain (a goodwill gesture) they will only pay ECU unit and 50% of the coding but i feel this is completely unfair considering i owned the car for a week when all these faults started.

I have lost the will to live with them and i have actioned a section 75 as i paid £500 deposit on my lloyds credit card - I've sent all images of splicing that the garage took, the warranty report, the emails, the invoice.

What are your opinions, what else can i do - i could literally cry with the stress of it all....

Thank you all for your time and input.

    Hello

How much are you claiming for the ECU costs?

      Hi Rob,

They agreed to pay for battery and fuel filter. I am claiming £1192 for battery, fuel filter, ECU and ECU coding
