    I would suggest you keep your communications in writing, or if you need to call then follow it up with an email setting out what was discussed. Blake Morgan are a firm of solicitors but it looks like a debt collection letter than a letter before action.

    If I was in your shoes, I would be writing to both VWFS and Blake Morgan setting out the position that you are currently in dispute and the matter is with the Financial Ombudsman. As I mentioned in my last post, sending further demands whilst there is an ongoing investigation is contrary to the CONC Rules. I am sure I have some example letters lying around somewhere I will try to hunt them out and get back to you, uness you have already written to them.

    There is a thread for posting the outcome of your VT although there isn't really any set format for it (click here). Feel free to post a summary and a link to this thread for other's to view.

      Thanks for the pointers. I have sent emails to both VWFS and Blake Morgan and received an email back from BM:

      Dear Sir

      We confirm our file has been placed on hold pending the outcome from the Financial Ombudsman.

      Yours faithfully

      Didn't say much but for me it's enough. I also emailed the ombudsman who replied saying they asked VWFS to put a hold on it.

      I know VWFS said it was an automated system and they can't do anything but I don't care how it works. If they've set up a system that can't be interrupted it's their own silly fault. So I will see if I get any more letters but at least it's all recorded.

      It seems that the ombudsman will be taking quite some time to get their VT ruling sorted.

        Thanks for the update.

        Do you have a copy of the full agreement by any chance, that you can upload on here? I'd like to see VWFS' T&Cs.

          Hi R0b - sorry for the very delayed response... I don't have the full agreement with me at the moment. I just popped back on now to say this situation is STILL ongoing - sitting with the ombudsman now. I haven't had any further letters from VWFS or Blake Morgan but this is really tedious. The car I got after this one went back is coming to the end of its 2 year lease next month..

          Hopefully it won't be the same situation with the BVRLA wear and tear guide / BCA collecting the vehicle.

          Did I read somewhere that you don't have to sign their appraisal when they collect the car?
