  • Help with Popla appeal - WON

    Hi, I have read various forums and found a great deal of useful information regarding Popla appeal templates. Please can anyone offer me some advice on an appeal I have put together, I do not wish to post the appeal as the Excel Parking Team may be looking at these forums and therefore a pre-prepared for their response (possibly) can I send a private in box message to an appropriate advisor?

      Hi, Thank you for your response - please can you advise - my car broke down in rush hour traffic - I pulled into the nearest car park which I thought was free as the Netto in Wolverhampton has closed down and boarded up. The barrier is always up, which is also misleading in suggesting it is a free car park. There are no signs along the back wall, where I parked and none along the entrance I took that leads to snow hill. I wrote to the company to advise I the above situation and received a reply stating I still need to pay, I also asked them to justify the amount they have fined me as it is unjust. Again they are proposing this is justified. Should I include this in my appeal - I have read mitigating circumstances are not successful, I even sent a copy of the receipt for the battery that I had replaced which caused me to break down, which appears to have made no difference..please help.

        Include it but do not rely on it.

        No signs, no genuine pre estimate of loss etc etc is where you'll win.

        Also make sure the notice is compliant if keeper liability is being relied upon.

          Sorry I am not sure what you mean by notice is compliant if keeper liability is being relied upon. I also wanted to add - the company are clearly unprofessional/dis-organised the notice I received states we received your appeal on the 22 March 2014 for a PCN issued 1st December 2014...so I made my appeal before the actual event took place...lol...please can you advise how to upload photos onto the forum..many thanks

                Standard guff excluding the date error which is insignificant. Was there a ticket on the vehicle ? Did a ticket arrive within 14/28 days ?

                          Photos of poor lighting none of the lamps but one was lit up during the time I parked - the text on the signs is very small and difficult to read unless you stand there and read for at least 15 mins - the barrier is always up which is also misleading - will this be of benefit?

                            There is no signs along the back wall or along the exist to snowhill...I have taken some video footage that I will include in my appeal.
