        Hi,

        I am really struggling to get out from the PCN send by MET. I stay in an flat and I have been allocated parking bay for my vehicle. MET has provided with Parking permit which expiries after 12 months and you need to collect parking permit after 12 months.

        As I was not in the country due to family emergency and forgot to collect it once I was back due to health issue, I was issued with 2 PCN for same reason.

        Now my appeal has been rejected and they have asked me to make an appeal with POPLA, I am confused what to do. As when I got the flat it was with parking Bay and why MET are making new rules to take money from me.

        Please advice.

          Hi Jemima,
          Is there any notices to say that a parking charge would be payable for any infringement of parking rules?
          More importantly, are there any parking rules on display, if so are they displayed clearly?
          Any contract you may have for parking is with the council (the owners of the car park).
          Write to the parking agents who issued you the ticket, and ask for a copy of any contract with them, (not the council) which obligates you to pay the £100.00 charge.
          Also ask for a copy of any contract they have with the council, that authorises them to issue a parking charge.
          Tell them that any contract you may have, is with the owners of the car park, and not with their agents, unless written confirmation as requested, is sent to you.
          You should also request that they justify the £100.00 charge, by showing any and all losses that they or the council have suffered by your parking where you did.
          Tell them it is your right to receive this information, according to the Office Of Fair Trading.
          Let me know their response.
          Always send letters by recorded, signed for post.
          Keep the receipt.

            Hi, sorry to jump in on your post. I'm a new member and found Legal Beagles from another motoring forum. Having read through this thread, I've decided to follow the advice given and am going to have a go at an appeal to MET Parking Services with the request for a POPLA code should they refuse my appeal.
            My over stay by 9 minutes was registered 19/12/15 and the PCN issue was dated 24/`12/15. I've got the statutory £100 to be paid by 21/01/16 (28 days from issue) or the reduced to £60 to be paid by 7/01/16 (14 days). What I have noticed is that neither of the payment time scales have not taken into the 3 banks holidays present within the required time scale. Do you think I've got a chance if I use this as a technicality in the potential POPLA appeal should my initial MET appeal is rejected.
            What I'm stating in my MET appeal is that the signage wasn't illuminated to allow me to see the sign, let alone read it. My guess is that MET will refuke my claim and I guess it will be my word against theirs. Being that there evidence is based on number plate recognition and their online photographs don't show the sign. From that point, I've realised the time-scale without taking into consideration the bank holidays.
            Would like to conclude by saying thanks to you guys for giving us laymen the pointers to have a go back at these extorecinant charges/invoices being issued by these bully boy parking companies. Of course, these companies also know the ropes, but it's got to be worth a shot.

              Hi John,

              I came across your post and wondered if I could use it for my appeal? I had parked at Banbury station and normally call RingGo to make a payment. However, my phone had no signal on the train. I therefore had to wait until I got to my conference and download the app using their wifi connection to make a payment. By which point, I had already been issued with a £100 fine. Do I have a case? I have the RingGo receipt that shows the payment. I thought I could adapt your post to say something along the lines of:


              ADDED BY ADMIN: DO NOT USE THE BELOW TEXT AS A TEMPLATE IF YOU RANDOMLY COME ACROSS IT ON THE INTERNET.....OR ANYTHING ELSE FOR THAT MATTER.

              I normally park at Banbury station and call RingGo to make a payment for this. However, on the date of my parking notice (19th January 2016), I had no signal on the train to make the call. I therefore was not able to pay for my ticket until I could download the app and pay for it online which was not until 11.42am (please see attachment). I therefore refuse to pay this absurd parking fine.
              In addition, I am NOT going to pay you any money, unless and until you can fulfill the following conditions:

              1. Validation of the alleged debt (the actual accounting), not a Photostat copy.
              2. Verification of your claim against me (a sworn affidavit or a hand signed invoice in accordance with The Bills of Exchange Act (1882));
              3. A copy of any alleged contract signed by both parties and therefore binding both parties.
              4. A signed copy of any contract you have with Banbury station, showing authorisation from them for the exorbitant charges you are demanding.

              Under common law, and in accordance with unfair consumer contract regulations, the cost of any penalty claimed, must reflect the damages and loss suffered by the company issuing it.
              England is a common law jurisdiction, and in accordance with Common Law, I do not have to prove anything.
              I hereby give you ten (10) days to reply to this notice from the above date with a notice sent using recorded post and signed under full commercial liability and penalties of perjury, assuring and promising me that all of the replies and details given to the above requests are true and without deception, fraud or mischief. Your said failure to provide the aforementioned documentation within ten (10) days, from the above date, to validate the debt, will constitute your agreement to the following terms:


              1. That the debt did not exist in the first place;
              OR
              2. It has already been paid in full;

              AND
              3. That any damages suffered, you will be held culpable;
              4. That you will not appoint an agent to act on its/your behalf in this matter and that any negative remarks made to any debt enforcement company or credit reference agency will be removed, and will be subject to £5000.00 in damages.
              5. You will no longer pursue this matter any further.
              6. You agree to pay all fee schedules.

              Please Note:
              I wish to deal with this matter in writing and I do not give your organization permission to contact me by any other means. Should you do so, I must warn you that this could constitute ‘harassment' and I may take action under Section 1 of the Protection from Harassment Act 1997 and the Administration of Justice Act 1970 S.40, which makes it a Criminal Offence for a creditor or a creditor's agent to make demands (for money), which are aimed at causing 'alarm, distress or humiliation', because of their frequency or manner..
