  • MET Parking Services advice - Won

Hi everyone. I'm a newbie here looking for a bit of advice.

I have been served with a parking fine of £100 from MET Parking Service. If I don't pay within a certain amount of time it goes up to £150.

I was at Mcdonalds outside Gatwick, I decided to pop in and grab something to eat. I failed to see the signs that say you only have a 60 minutes parking limit. Granted it was there for a while, 77 minutes to be precise according to the letter, so I was 17mins late getting back to my car and leaving. I have no proof that I was in there eating, who keeps a receipt from a Mcdonalds?
They send me a picture of my car arriving and leaving. I think £100 is really harsh for being 17 minutes over is there anything I can do or do I just have to suck it up and pay?
    thanks in advance.

    Re: MET Parking Services advice

Naughty naughty. Maximum charge is £100, oops.

    Anyway,

    dear Sirs,

I, as registered keeper, wish to invoke your appeals procedure. The driver was a customer of McDonalds and did not see the signage. In any event the charges are penal and not a genuine pre estimate of loss as well as being an amount larger than permitted under the BPA code of practice to which you subscribe.

I will not name the driver as i am under no statutory obligation to do so.

Please accept my apeal or supply a popla code.

    Yours etc

Edit http://www.legalbeagles.info/forums/...-Appeal-Letter to suit for a popla appeal.

It does work http://www.legalbeagles.info/forums/...pany-victories Yes that hasn't been updated for a while but it'd just be more of the same

        Hi,
        I love these cases...
I recently had two, and never had to pay either.

Once you have sent this by recorded, signed for post. You probably will not get a response.
Or Met Parking may very well try to fob you off with another demand.
If they do, let me know.
We go on then to letter No 2. which I will post for you then.
        Regards,
        John

I took the advice from Myster1, thank you for the letter. They wrote back to me saying they will reduce the fine to £50 if I pay with in 10 days. Which I thought was a bit odd.
What you think shall I just push my luck and wright the 2nd letter?

                      Hi everyone.
Its been a while since I sent the 2nd letter to the Popla. Thought I would let you know the out come.
I received a letter from them saying that MET Parking services failed to send them any evidence of any kind of the offence. And there for they had no choice but to let me off the whole £100 fine. WIN

Just wanted to thank you all for your help and advice on this, I really appreciate it.

I received parking fine from MET stating i was to send them a parking charge for £100 as I had been parked in mcdonalds car park for several minutes over their 1.5 hours allowed. I sent the above letter to them within the time allowed and i have received a reply stating they reject my appeal. They also sent a 'site map' which shows the places where the parking signs are in the carpark.
I also received a POPLA application form. Please can you post your 2nd letter as said above and advise how to do the form?
                        Many thanks

                          Hi John,

I recently got a MET parking charge whilst parked in Barns Elms Sports Centre car park for not parking in a bay. The car park was full so i just stuck it somewhere reasonable.

The charge is £100 or reduced to £60 if i pay within 14days.

My case it is slightly different to MacDonalds incidents posted so i just thought it worth asking how you would approach it?

Your (or anyones) advice/suggestions would be much appreciated

                          Thanks,
                          James

                              Hi Johnboy
You seem to be very good at this so wonder if you can help me:
I received on 8.4.15 parking charge notice for £100 - for 'parking outside markings of a parking bay' at my local gym/swimming pool where I am a member - it is a council run premises but parking is contracted out. There is no charge for parking. The car park was full as it was during Easter holidays with lots of kids going swimming and, due to construction work, 6 spaces less available for parking. I parked in a space not considered a bay but also not obstructing anything. Do I have a case please. Any advise greatly appreciated, many thanks

                              Dear Sir / Madam,
I am NOT going to pay you any money, unless and until you can fulfill the following conditions.

                              1. Validation of the alleged debt (the actual accounting), not a Photostat copy.
                              2. Verification of your claim against me (a sworn affidavit or a hand signed invoice in accordance with The Bills of Exchange Act (1882));
                              3. A copy of any alleged contract signed by both parties and therefore binding both parties.
                              4. Evidence and absolute proof that the car-park was being used by me, other than in accordance with your, or McDonald's, terms and conditions.
                              5. Absolute proof by way of verified and signed accounts, not Photostat copies, of any actual loss to McDonald's.
                              6. A signed copy of any contract you have with McDonald's, showing authorisation from them for the exorbitant charges you are demanding.

Under common law, and in accordance with unfair consumer contract regulations, the cost of any penalty claimed, must reflect the damages and loss suffered by the company issuing it.
England is a common law jurisdiction, and in accordance with Common Law, I do not have to prove anything.
                              I hereby give you ten (10) days to reply to this notice from the above date with a notice sent using recorded post and signed under full commercial liability and penalties of perjury, assuring and promising me that all of the replies and details given to the above requests are true and without deception, fraud or mischief.                               3. That any damages suffered, you will be held culpable;
