    Thank you so much. I can't open it on my phone, I will go on the computer once my children have gone to Grandma's. The call will be because I called them and ask if they were going to replead their case. She said we can't do that then said she could take my number and someone call me back. Well a week later they try and call once then email and said well we called if you want to discuss the case call us back. I'm sure it won't be to replead, they had no interest when I called them before. But I will return the call. Their poc are one line with a pcn number then the rest focuses on how they have worked out the interest they've added!

      Morning, I didn't hear anything back, so the defence has just gone in. Do I just sit and wait now? Thanks again for all your help so far, it really has been invaluable.

          I haven't really got anything to add, I submitted my defence and am waiting to hear. I submitted it about 2 weeks ago so they still have two weeks or just over to make their move. Does their case look the same as mine?

            Thanks for the response. Yes it is pretty much identical. Same info on particulars of claim. The difference is that I had no letters from Parking Control Management or Letter Before Action from Gladstone. All I have is the claim form which is exactly the same as your one.

              I think the advice would probably be the same because you are saying effectively you can't defend what you don't know. Was it the same car park? Have you acknowledged it online?

                No it was a different place. I have filed AOS and emailed Glastone asking them to replead. I was kindly given this info by mystery1, same as you.

                        Dear Ms McClean,

                        Thank you for your email of xxxxxxx the contents of which are noted. This case is not suitable for a paperwork only hearing. In fact, it's not suitable for any hearing. I have communicated to yourselves about the inadequate nature of your claim and have also reiterated such in my defence. Had it not have been for the prohibitive £255 fee i would have attempted to apply for summary judgement.

                        I asked that you correct these glaring issues and indeed offered a 28 day extension pursuant to CPR 15.5 in order that the case could be pleaded properly and a defence to a proper claim filed. As this has been rejected, or at least ignored, then i'm afraid i cannot, and will not agree to a paperwork only hearing.

                          Thank you, I will forward that now. There is something attached that they have filled out, which says directions questionnaire (small claims track) and that's it? Am I able to force them to take me to court? Or do I have to go with the paperwork hearing?

                            Post it up. It'll just be their DQ filled in which they have to send to you. You have to send yours to them as well as the court too, once th court send it out to you.

                            Ultimately the court decides how to handle a case. They have requested a paperwork only hearing as they are entitled to do just as you are entitled to say, stuff that.

                                I have emailed over the dq to be uploaded when possible. It comes across to me like they've requested the paperwork only hearing not because it is straight forward but because they don't want to be contested. Would that be a fair assumption?
