Got that.

What i want to know is what did you give the court to get this far ? If you gave them nothing you would not have got to this stage.

Can you also post up the court order too.

i filled in a defence and counter claim form (N9B) and emailed this to ccbcdefendants@hmcts.gsi.gov.uk on the 17-5-14. using this following defence which i edited as per instructions. Re: parking eye county claim

Ok.

You need to add a heading

IN THE [TOWN]	COUNTY COURT	CASE No.
BETWEEN
	[IVOR PROBLEM]	Claimant
	AND
	[JUSTIN TIME]	Defendant

DEFENCE

Then check and edit any info from

helpmepls1.rtf

Then add at the end

Statement of Truth
I believe that the facts stated in this Defence are true.
Dated this 2nd day of June 20....
To the court and
to the Claimant

	.......................... JUSTIN TIME Defendant
	of [Address],
	at which address he/she will accept service of proceedings.

Once you have it all as one document with the correct details email it to ccbcdefendants@hmcts.gsi.gov.uk in the subject header of the email put Defence parking eye ltd v me case no xxxxx

Then log on to the mcol site and go through the stage to enter the defence but instead of the defence put emailed to ccbcdefendants@hmcts.gsi.gov.uk on 16/05/14. (for safety reasons really)

-parking eye then sent notice that they will still be proceeding. i have posted their reply to my defence on previous posts dated 3-6-14.

-i received and then filled in a directions questionnaire (small claims track)

-i was then sent a notice of transfer of proceedings

-and finally I receieved a notice of allocation to the small claims track (hearing). which is on 31-10-2014

So the defence is in already. There is no need to resubmit that.

For the witness statement :- http://www.johnantell.co.uk/informat...ness-statement basically a witness only tells the story of what happened and what they saw. Post it up once done and i'll have a look this afternoon. Both of you should do one.

You won't need documents as all you've referred to is stuff they'll produce such as signage but the court cases should be provided. Most can be found http://www.parking-prankster.com/case-law.html and http://13oldsquare.com/files/documen...proved_jdg.pdf

Skeleton arguments we can do later on.

i was going over parkingeye's reply to my defence and i noticed that p.e pictures to the signs are differant to the ones i took on my camera. is this significant??
i.e the wording has changed

I would say so, as your pictures are evidence of the signage at the time of the alleged contravention when PE sent their "Invoice" Theirs will no doubt be ones of signage possibly from elsewhere even. They are that silly.

Your witness statement can't give evidence of what your husband did. He should do one of his own. He should include that he took pictures and the pictures should be reference and included. Exhibits A,B,C or Exhibts 1,2,3 etc.
