  • directions questionnaire and notice of proposed allocation to small claims....

    I have been away on holiday and have now been sent Notice of Proposed Allocation to the Small Claims Track
    Am I meant to be filling this in AND the directions questionnaire.

    I previously returned the acknowledgment of service and in the meantime the above two letters have been sent
    Apologies for coming across as thick but this is something I have never dealt with not really understand the process of. I greatly appreciate all help.

    Is this in connection with another thread? It would help to have more details. Perhaps read the instructions on the form? Have you sent a defence?

          I replied to the initial letter from Norhtampton CC via an online form and just ticked the box to say I wanted to defend. I actually wrote nothing more than that as that is what I thought I was meant to do?
          I now have this directions questionnaire from Gladstones and also Notice of Proposed Allocation to the Small Claims Track/directions questionnaire from CC Business Centre . I have read the last form which is basically saying it is going to small claims and what is my defence and do I want mediation.
          I have read on previous posts that mediation is pointless.
          I am really at a loss now of what I am meant to do and what I should reply? Should I just call and negotiate a settlement? I was away on holiday and the deadline is tomorrow? I have been waiting for some help - I guess I am not explaining myself well enough? If I could have some links to point me in the right direction? Thanks for all help

              Tactically, as they have refused mediation, if it were me I'd say yes to it.
              The courts do like to see at least an effort by both parties to negotiate outside of the formal court arena.
              It could earn you Brownie points, who knows?

                This is your number one priority, if you haven't filed a defence and the money claim system will allow you to still file one you need to get it in ASAP.

                What is your reason for not owing them the money they are claiming?

                If you have or once you do file a defence, this is good advice even if you know the other side will refuse as you can point to it as how unreasonable they are.

                Also reading back, I'd oppose hearing the matter on paper and you want a hearing at your local court. It sounds to me llike they don't really want to pay a hearing fee or actually turn up, so push them and see where it takes you.
