  • MET Parking PCN

    Hello,
    seeking your excellent advice on this MET PCN I've just received.
    Didnt even realise the driver had gone 16 minutes over the hour, the driver went into the Gatwick McDonalds as felt unwell. After eating got the "trots", then when the driver got outside the car was blocked in by someone waiting to get into a space.
    Even £50 seems extortionate for just 16 minutes.
    can you advise what to do first please?
    The issue date is 18/07/17 and the 14 day period is by 01/08/17.
    very grateful for advice.

    Hi Hfbee & welcome to LB

    First things first....Do not ID the driver (even by implication).
    It is not unknown for these companies to trawl the fora.
    Best to edit your post accordingly. (Just change to 'the driver did XX....')

        Hi there, I found a template appeal letter which I sent saying that the amount was not in proportion to the 16 minutes, plus they did not put the model of car on the ticket.
        They rejected the appeal saying that they don't need to break down their losses, they don't need to provide a copy of their contract with the client.
        I did not put in the appeal that the driver had become sick at the McDonalds (which is why the car left 16 minutes late).
        Would you advise that an appeal to POPLA is sent.
        I'm very confused.

          They have now written to say the refuse the appeal and I should pay the £50 or appeal to POPLA using the number they've given me.

          Can you say if you think I should do a POPLA appeal or just pay this £50 and be done with it? It's now a day or two past the 14 days so even if I pay the £50 they might demand £100. That's a lot to pay for a part-time worker on a very low income!
          I'll get copies of the letters posted up as soon as I have them xx

            What was the date of the actual parking event?
            Do you have the Notice to Keeper? If so, post it up (obscuring personal details, but leave dates visible).
            Also up-to-date pictures of site signage if possible.

              Hi, the date was 18/07/2017. I'm not very good at posting documents, I have sent them to Kati and hope she will post them for me.

                So the Notice to Keeper was sent out to the registered keeper on the same day that the parking incident occurred?

                  No, I'm SO sorry, the date of incident was 10th July and the PCN was sent out on 18th July. My mistake!
                  I sent an appeal on 28th July, this was rejected by them, via a letter they sent to me on 04 August.

                    We'll take a look at the NtK for technical defences when it arrives.
                    Any chance of site signage pics? (Important, as that is what the contract (& therefore the alleged breach) is based on.
                    I'm guessing this was via ANPR?
                    If so, & bearing in mind that you have 10 mins grace period to exit the site, that only leaves 6 mins to find a space (sometimes the driver has to wait for one to become available, or wait for other drivers to manoevre), get out of car & read/digest the 'contract'.
                    Although the grace period allowable for this is not specified, it must be 'reasonable'.

                          Btw, not necessarily 16 mins.
                          The car was 'clocked' at 11:59 entering (though not yet parking in) the car park. Could have been closer to 12:00.
                          So a minute or so to find a space & stop? (12:01)
                          10 mins grace period to exit (BPA Code of Practice)
                          4 mins or so to read/understand/agree to the sign 'contract'?

                              So would this be the grounds that I appeal on? The time limit?

                              one other question, I read somewhere that they should list the make/model of the car. Is this so? It wasn't on my PCN. H
