All I recieved was 2 pages of the agreement terms and conditions no signature on it they have just put my name on top of it then on another it's just says date of opening account last payment date the default date and when they bought it nothing much at all it's all these different dates for the default and 2 years after the first missed payment does not add up none of it .... it seems to me the default date is very close to when they bought it

Hi nem can they start the limitation from the default date being 2 years from last payment I cannot see how this will stand up in court being so late thanks kitty

If what you have received is one set of T's and C's then it does not constitute a reconstituted agreement.

The requirements are.

The T's & C's relevant when the account was opened.

The T's and C's relevant when the account was closed.

Any other documents mentioned in those T's and C's.

Yours and the creditors name and address as it was when the account was opened.

I see from the " log" page that is it states that " no CCA available and a recon was requested but if there's only that one page of t's and c's the alleged agreement is incomplete.

Does it have your name and address as it was when the account was opened?

There should be 2 distinct sets of t's and c's those relevant when the account was opened and those relevant when the account was closed.

There is also no certified current statement of the account.

Last payment date shows clearly as 12/2009 so the default was placed very late which is unfair.

So I think challenging their claim that the default date stared the relevant 6 year period is wrong so if taking the date of the last payment + 3 missed payment that would be the start of the 6 year period.

Yep got it Kitty,

So TWO pages of t's& C's with a not saying " recon" to comply with the CCA request there has to be two distinct set of t's & c's one for when the account was opened and one relevant when the account was closed. You name and address should be the one relevant when the accounted opened. Plus any other documents mentioned in the t's & c's.

Hi nem so are u saying this cca is not correct that they have sent me I don't understand it at all there is no actual statement of the account either just that log bit thanks I find it very confusing to what a cca should be if this isn't right what they hav sent me surely it won't stand up in court will it thanks kitty
